Motor Vehicle Standards Regulations (Amendment)

Section 42 of the Motor Vehicle Standards Act 1989 (the Act) provides that the Governor-General may make regulations for the purposes of the Act. Section 24 of the Act provides that the regulations may prescribe fees to be paid to the Commonwealth in respect of, amongst other things, approval for the placing of compliance plates on vehicles.

The Schedule to the Motor Vehicle Standards Regulations (the Regulations) prescribes the fees for a number of matters. Item 1 prescribed a fee of $6.50 for granting of authority to place a compliance plate on a vehicle other than a motor cycle. Item 2 prescribed a fee of $3.25 for granting of authority to place a compliance plate on a motor cycle.

The amendments to the Regulations increase the fees prescribed by Items 1 and 2 to $7.50 and $3.75 respectively. The increased fees are expected to raise an additional $600,000 per annum. In addition, a minor error in the heading to the Schedule has been corrected.

The amending Regulations commence on 1 March 1994.

Overview

The Motor Vehicle Standards Regulations (Amendment) 1994 No. 23, issued under the authority of the Minister for Transport, amends the Motor Vehicle Standards Regulations 1989 to update the fees associated with the approval of compliance plates for motor vehicles. Enacted in response to the provisions outlined in Section 42 of the Motor Vehicle Standards Act 1989, these regulations aim to ensure that the fees prescribed for the approval process are adequate to cover the administrative costs and maintain the integrity of the compliance certification process. The policy objective is to facilitate a smooth and efficient regulatory environment for vehicle compliance, while also generating revenue for the Commonwealth. The amendments increase the fee for placing a compliance plate on vehicles other than motor cycles from $6.50 to $7.50, and the fee for motor cycles from $3.25 to $3.75, with the expectation of raising an additional $600,000 annually. These changes are designed to keep pace with inflation and operational costs, ensuring the regulatory framework remains current and effective.

Scope and Application

The Motor Vehicle Standards Regulations (Amendment) 1994 No. 23 applies to the regulations governing fees for the approval of compliance plates on vehicles, falling under the Motor Vehicle Standards Act 1989. This legislation applies to all persons or entities seeking to place compliance plates on vehicles, encompassing a broad spectrum of industries involved in the manufacturing, importation, and registration of vehicles. The amendment pertains specifically to the fees for the granting of authority to affix these compliance plates, which is a critical aspect of vehicle registration and compliance with motor vehicle standards. The increased fees are designed to raise additional revenue and ensure the enforcement mechanisms remain financially sustainable. The regulations have a Commonwealth reach, meaning they apply nationally across Australia. There are no specific exclusions or exemptions mentioned in the explanatory statement, though it is implied that the regulations apply broadly to all vehicles except for those specifically excluded by other provisions of the Act or subsequent regulations. The amendments to the Regulations extend the application by altering the prescribed fees, as authorised by Section 42 of the Motor Vehicle Standards Act 1989, and these changes take effect from 1 March 1994.

Key Provisions

The Motor Vehicle Standards Regulations (Amendment) 1994 No. 23 introduces modifications to the fees outlined in the Motor Vehicle Standards Regulations (the Regulations). Specifically, section 42 of the Motor Vehicle Standards Act 1989 (the Act) empowers the Governor-General to enact regulations for the purposes of the Act, and section 24 of the Act allows for the prescription of fees. In the case of compliance plate approval, Item 1 of the Schedule originally set a fee of $6.50 for vehicles other than motorcycles and $3.25 for motorcycles (Motor Vehicle Standards Regulations, Schedule, Items 1 and 2). The amendments increase these fees to $7.50 and $3.75 respectively. This change aims to generate an additional revenue of $600,000 annually. Additionally, the amendments rectify a minor error in the heading of the Schedule. The Regulations impose obligations on entities and individuals involved in the placement of compliance plates on vehicles. Those seeking to place compliance plates on vehicles, excluding motorcycles, must now pay a fee of $7.50, and for motorcycles, the fee is $3.75. These fees are payable to the Commonwealth and must be remitted as per the amended Schedule of the Regulations. The amendments are designed to ensure compliance with the Act by requiring updated fee payments for compliance plate approvals. Failure to adhere to the new fee structure outlined in the amended Regulations could result in legal repercussions. While the explanatory statement does not explicitly detail specific penalties for non-compliance, breaches of regulations under the Motor Vehicle Standards Act 1989 can lead to both civil and criminal penalties, depending on the nature and severity of the breach. Civil penalties may include fines, and in more severe cases, criminal penalties could apply, including imprisonment. However, the exact nature of the penalties is governed by the overarching provisions of the Act and may vary based on the specific circumstances of the breach. In summary, the Motor Vehicle Standards Regulations (Amendment) 1994 No. 23 adjusts the fees for compliance plate approvals, increasing them to $7.50 for non-motorcycle vehicles and $3.75 for motorcycles, aiming to generate additional revenue. It also corrects a minor error in the Schedule's heading. Compliance with these new fees is mandatory for all entities and individuals seeking to place compliance plates on vehicles. While the explanatory statement does not detail specific penalties, breaches of the regulations could result in civil or criminal penalties under the Motor Vehicle Standards Act 1989.
