Overview

The Military Superannuation and Benefits Act 1991 was enacted to provide for the administration of military superannuation and benefits. This legislation was introduced to address the need for a structured and fair system to manage the retirement benefits of military personnel. The Act was enacted by the Parliament of Australia, reflecting a commitment to ensuring that those who have served in the defence forces are provided with adequate support upon retirement. The policy objective of the Act is to establish a comprehensive framework that guarantees the financial security of military retirees, taking into account their unique service circumstances and contributions. The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 64 amends the interest rates applied to certain benefits under the Act. This legislative instrument, made by the Military Superannuation and Benefits Board of Trustees No. 1, adjusts the exit rate of interest from -4.10% per annum to 0.25% per annum. This amendment aims to reflect current economic conditions and ensure that the benefits provided under the Act remain sustainable and equitable for all beneficiaries.

Scope and Application

The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 64 applies to the Military Superannuation and Benefits Board of Trustees No. 1 and governs the interest rates associated with military superannuation and benefits for members of the Australian Defence Force. This determination specifically amends the Principal Determination, which refers to the Military Superannuation and Benefits Act 1991 (Interest) Determination No. 1. The amendment changes the exit rate of interest from -4.10% per annum to 0.25% per annum, effective from 21 May 2001. The Act applies nationally within the Commonwealth of Australia and is intended to regulate the financial benefits and interest rates for military superannuation. This legislative instrument ensures that the determinations and amendments are formally recorded and implemented by the Trustees, who are authorised to affix the Common Seal of the Board to signify their approval and enactment of the changes.

Key Provisions

The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 64, effective from 21 May 2001, modifies an existing interest rate set out in the Principal Determination (Clause 4). Specifically, it changes the exit rate of interest from -4.10% per annum to 0.25% per annum, impacting how interest is calculated for military superannuation and benefits. This adjustment ensures that the interest rate applied to the superannuation and benefits is more favourable to the beneficiaries, reflecting changes in economic conditions or financial policies. Under this determination, the Military Superannuation and Benefits Board of Trustees No. 1 has the responsibility to ensure the updated interest rate is correctly applied in all relevant calculations and communications concerning superannuation benefits. Trustees must ensure all relevant stakeholders are informed of the change and that it is appropriately implemented in the administration of military superannuation funds. The Board must also maintain accurate records of these changes to comply with legal and regulatory requirements. Failure to comply with the provisions of this determination could result in legal repercussions for the Board and its trustees. Breaches may lead to civil penalties, including fines, or other legal actions that could be pursued by affected parties. The exact nature and extent of penalties are not specified in the text, but they could encompass a range of administrative or judicial consequences aimed at enforcing compliance with the legislative requirements. Trustees must act diligently to ensure the new interest rate is applied correctly to avoid any potential legal or financial liabilities.
