Overview
The Military Superannuation and Benefits Act 1991 was enacted to address the need for a comprehensive framework governing the provision of military superannuation and benefits to members of the Australian Defence Force and their families. This Act was introduced to ensure that service members and their dependants receive appropriate financial support post-service, addressing gaps in existing retirement and disability benefits provisions. The Military Superannuation and Benefits Act 1991 was enacted by the Parliament of Australia with the policy objective of providing a structured and equitable system for superannuation and benefits for military personnel, reflecting their unique service commitments and risks.
This legislation empowers the Military Superannuation and Benefits Board of Trustees to make various determinations, including setting interest rates applicable to the superannuation and benefits schemes. The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 60, which amends the exit rate of interest from -2.23% per annum to -3.67% per annum, is an example of such a determination. This amendment was made by the Military Superannuation and Benefits Board of Trustees No. 1, pursuant to clause 3 of the Trust Deed under Part 2 of the Act, effective from 24 January 2001. This determination underscores the Board's role in managing and adjusting financial parameters to maintain the sustainability and fairness of the superannuation and benefits schemes.
Scope and Application
The Military Superannuation and Benefits Act 1991 applies to the management and administration of superannuation benefits for members of the Australian Defence Force, including both current and former members. This legislation ensures that these members are provided with a reliable and secure retirement income. The Act governs the Military Superannuation and Benefits Board of Trustees, which is responsible for administering these benefits and ensuring compliance with the terms outlined in the Act. The Act extends its reach nationally, applying throughout the Commonwealth of Australia, and its provisions are enforced by the Board to ensure that all eligible members receive their entitled benefits. Any amendments or specific adjustments to the Act, such as the modification of interest rates for benefits calculations, are made through determinations like the Military Superannuation and Benefits Act 1991 (Interest) Determination No. 60, which is a subordinate instrument that provides detailed operational instructions under the principal Act.
Key Provisions
The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 60 (section 1) is a legislative instrument that amends the interest rates applied to military superannuation accounts. This determination amends the Military Superannuation and Benefits Act 1991 (Interest) Determination No. 1 (section 4). Specifically, it changes the exit rate of interest from -2.23% per annum to -3.67% per annum (section 4). The amendment took effect from 24 January 2001 (section 2).
The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 60 imposes obligations on the Military Superannuation and Benefits Board of Trustees No. 1, as it requires them to update the interest rates applied to military superannuation accounts as specified in the determination (section 4). The Board must ensure that the new exit rate of interest, -3.67% per annum, is applied to all relevant accounts from the effective date of the determination, 24 January 2001.
The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 60 does not explicitly outline offences, penalties, or consequences for breaches. However, failure to comply with the determination could potentially lead to legal action or penalties under the Military Superannuation and Benefits Act 1991 or related legislation, as it pertains to the management and administration of military superannuation accounts. The maximum penalties for breaches under the Military Superannuation and Benefits Act 1991 are not specified in the determination but could include fines, imprisonment, or both, depending on the nature and severity of the breach.
