Overview
The Military Superannuation and Benefits Act 1991 was enacted by the Parliament of Australia to address the need for a comprehensive legislative framework governing military superannuation and benefits. This Act was designed to provide for the establishment and administration of a superannuation scheme for members of the Australian Defence Force and their dependants, ensuring financial security for these individuals upon retirement or in the event of death or disability. The Act was introduced to rectify the gaps in pension and benefit provisions for military personnel, providing a structured and equitable system for superannuation. The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 41, made under the authority of the Military Superannuation and Benefits Board of Trustees No. 1, amends the interest rates applicable to superannuation accounts as per the principal determination. This legislative instrument aims to update and align the interest rates with current economic conditions, ensuring the sustainability and relevance of the superannuation benefits provided to military personnel and their families.
Scope and Application
The Military Superannuation and Benefits Act 1991 applies to the management and administration of superannuation and benefits for members of the Australian Defence Force, including current and former military personnel, as well as their dependants. This Act pertains to the governance and oversight of the Military Superannuation and Benefits Board of Trustees No. 1, which is responsible for administering the benefits and pensions outlined under the Act. The legislation operates on a national level, encompassing all states and territories within the Commonwealth of Australia. The Act includes provisions for the calculation and payment of interest rates on superannuation funds and benefits, as evidenced by the Military Superannuation and Benefits Act 1991 (Interest) Determination No. 41, which specifies amendments to interest rates applicable to certain periods. Notably, this legislative instrument amends the Principal Determination to adjust the interest rates effective from 1 July 1999, thereby impacting the computation of superannuation and benefits for the specified period. The determination also extends to the inclusion of a new interest rate for the period 1 July 1998 to 30 June 1999, reflecting changes in economic conditions and policy adjustments.
Key Provisions
This determination, titled the Military Superannuation and Benefits Act 1991 (Interest) Determination No. 41, amends the Military Superannuation and Benefits Act 1991 (Interest) Determination No. 1, as referenced in clause 3 of the Trust Deed under Part 2 of the Military Superannuation and Benefits Act 1991. The amendment is effective from 19 August 1999 and involves changes to the interest rates applicable to certain periods. Specifically, clause 5 of the Principal Determination has been revised to reflect new dates and interest rates. The determination changes the date from 1 July 1998 to 1 July 1999 and alters the exit rate of interest from 7.9% per annum to 12.4% per annum. Additionally, the Schedule to the Principal Determination has been updated to include an interest rate of 8.3% per annum for the period from 1 July 1998 to 30 June 1999.
The Military Superannuation and Benefits Act 1991 (Interest) Determination No. 41 imposes specific obligations on the Military Superannuation and Benefits Board of Trustees No. 1. The Board is responsible for administering the amended interest rates as specified in the determination. Trustees must ensure that these new rates are applied correctly to the relevant periods, maintaining accurate records and calculations to support the adjustments. Trustees must also communicate these changes to relevant stakeholders, such as superannuation fund members and other interested parties, to ensure transparency and compliance with the updated provisions.
Breaches of the obligations imposed by this determination may lead to civil or administrative consequences. The Board is tasked with ensuring compliance with the amended interest rates and any failure to do so may result in legal or administrative actions. While the specific penalties are not detailed in the determination, breaches of similar provisions under the Military Superannuation and Benefits Act 1991 could potentially result in financial penalties, corrective actions, or other remedial measures. It is essential for the Board to adhere strictly to the requirements set forth in the determination to avoid any adverse consequences.
