Overview

The Provisional Regulations under the Defence Act 1903-10, enacted in 1911, were introduced to address immediate administrative needs concerning the military forces of the Commonwealth. This legislative instrument was issued by the Governor-General in Council, acting on the advice of the Federal Executive Council, and is intended to come into immediate operation due to the urgency of the matter. The primary objective of these regulations is to ensure that active members of Rifle Clubs maintain their musketry skills by mandating participation in a prescribed course of musketry. Failure to comply with this requirement for two consecutive years results in the member being struck off the club's roll and rendered ineligible to rejoin for a period of twelve months. This measure aims to uphold standards and readiness within the military forces.

Scope and Application

The Provisional Regulations under the Defence Act 1903-10 pertain to the management and discipline of military forces within the Commonwealth of Australia. These regulations apply specifically to active members of Rifle Clubs, imposing a mandatory requirement to complete a prescribed course of musketry within a given period. Failure to comply with this requirement for two consecutive years results in the individual being removed from the club's roll and barred from rejoining for a period of twelve months. The regulations extend their jurisdiction to the Commonwealth level, impacting Rifle Clubs that are associated with military forces. There are no stated exclusions or exemptions within the text provided, and the application is immediate upon certification by the Governor-General. The reach of these regulations is limited to the Commonwealth, specifically targeting the conduct and transactions related to Rifle Clubs as part of military preparedness and discipline. The Provisional Regulations come into immediate effect, highlighting the urgency and the necessity for strict adherence to the outlined requirements.

Key Provisions

The primary operative sections of these Provisional Regulations under the Defence Act 1903-10, specifically Regulation 522a, pertain to the administration and membership of Rifle Clubs associated with the military forces of the Commonwealth. Regulation 522a requires any active member of a Rifle Club to perform a prescribed course of musketry annually. Failure to complete this course for two consecutive years results in the member being removed from the club's roll by the Officer in charge of Rifle Clubs and Reserves. Additionally, the member becomes ineligible to rejoin any Rifle Club for a period of twelve months from the date of their removal. These provisions aim to ensure that all active members maintain a certain level of proficiency and engagement with the club's activities. The Act imposes several obligations on the parties involved. Active members of Rifle Clubs must adhere to the requirement of completing the prescribed musketry course each year. This is a condition of their membership and continued participation within the club. The Officer in charge of Rifle Clubs and Reserves is tasked with enforcing this requirement and has the authority to remove members who fail to meet the specified criteria. Clubs themselves are required to ensure that their members are aware of and comply with this regulation, maintaining accurate records of participation and removals as necessary. Failure to comply with Regulation 522a results in specific consequences. Members who do not complete the required musketry course for two consecutive years will be struck off the club's roll and rendered ineligible to rejoin any Rifle Club for twelve months. Although the regulation does not explicitly state penalties for non-compliance, the removal from the club and the ineligibility to rejoin serve as deterrents and consequences for failing to meet the mandatory requirements. These measures are designed to maintain the standards and readiness of Rifle Club members, ensuring they remain proficient and engaged in their military activities.
