Overview

Statutory Rules 1907 No. 62, the Provisional Regulations under the Defence Acts 1903–1904, was enacted to address the urgent need for updated regulations concerning rifle clubs within the military forces of the Commonwealth of Australia. These regulations were introduced by the Governor-General in Council, acting on behalf of the Commonwealth of Australia, to ensure the effective management and control of rifle clubs. The overarching policy objective was to streamline the administrative processes and ensure the proper conduct and discipline within these clubs, aligning them with the standards set forth by the Defence Acts. The regulations aimed to improve the governance and operational efficiency of rifle clubs, providing a clear framework for their management and the resolution of any issues that might arise within their membership.

Scope and Application

The Provisional Regulations under the Defence Acts 1903–1904, specifically targeting Rifle Clubs associated with the military forces of the Commonwealth, apply to these clubs and their members, with particular emphasis on their operational standards and membership regulations. The Regulations directly affect the administration and conduct within Rifle Clubs, including the age of membership, oath-taking procedures, and disciplinary measures. The amendments and insertions made to the Regulations detail specific operational aspects such as the age requirement for membership, the process for striking off members for misconduct, and the formalities for oath-taking prior to membership. The provisions also include adjustments to the roles and powers of the Rifle Club committee and the Captain, emphasising the need for oversight and adherence to military orders. These Regulations extend to Rifle Clubs formed of members of the Staff of any Submarine Cable Station, with specified exceptions for age requirements. The application of these Regulations is geographically bound to the Commonwealth of Australia, indicating a national reach. While the Regulations themselves do not explicitly state exclusions or exemptions, the specific nature of their application to Rifle Clubs implies that they do not extend to other types of military formations or civilian entities. The Regulations are subject to further modifications through subordinate instruments, allowing for adjustments to keep pace with evolving military needs and operational standards.

Key Provisions

The Statutory Rules of 1907, No. 62, titled "Provisional Regulations Under the Defence Acts 1903–1904," introduce amendments to the regulations governing rifle clubs associated with the military forces of the Commonwealth. These amendments include several changes to age requirements, membership criteria, and disciplinary actions. Specifically, Regulation 514 reduces the age for membership from 18 to 16 years. Regulation 517 specifies that membership is as an active member of a Rifle Club. Regulation 519 mandates that a Dot card must be produced prior to taking an oath. Regulation 522 allows the Officer Supervising Rifle Clubs to strike off the roll any member deemed unfit by the Captain, with the decision subject to review by the Club's Committee. Regulation 529 broadens the scope of meetings to include both general and committee meetings. Regulation 535 replaces "Standing Orders" with "Military Orders" and removes the requirement for classification according to a standard. Regulation 555 revises the process for drafting by-laws, stipulating that these must be approved by the club at a general meeting and confirmed by the Officer Supervising Rifle Clubs. These regulations impose specific obligations on the entities and individuals they govern. Rifle clubs must ensure that their members meet the updated age requirements and that they adhere to the outlined processes for oath-taking and membership management. The clubs are also mandated to establish and maintain appropriate by-laws that are subject to oversight and approval by both the Officer Supervising Rifle Clubs and the club’s general meeting. The Captain of each club is entrusted with significant responsibilities, including presiding over meetings and recommending disciplinary actions. The Officer Supervising Rifle Clubs has a supervisory role, including the final confirmation of by-laws and the ability to strike off members as necessary. Violations of these regulations may result in various consequences. The specific offences and penalties are not detailed in the provided text, but under the Defence Acts 1903–1904, breaches could potentially lead to civil or criminal consequences. For instance, failure to comply with membership requirements or by-law regulations might be treated as a civil offence, with potential penalties such as fines or the dissolution of the club. Serious misconduct or neglect of duties by club officers could lead to criminal charges, depending on the severity of the breach. The precise penalties are not specified in the regulations but would be determined in accordance with relevant legal provisions.
