REGULATIONS UNDER THE DEFENCE ACT 1903-1970.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1970.

Amendments of the Military Financial Regulations†

Higher duties allowance.

1. Regulation 28 of the Military Financial Regulations is amended—

(a) by omitting sub-regulations (5c) and (5d) and substituting the following sub-regulation:—

“ (5c) Higher duties allowance is payable to a member in respect of a period of absence on recreation leave if—

(a) he was in receipt of higher duties allowance in respect of the relevant day; and

(b) his Commanding Officer has certified that he would have continued to perform duties in respect of which higher duties allowance would have been payable but for that absence.”; and

(b) by omitting from sub-regulation (5f) the words “ sub-regulations (5c) and (5d) of this regulation ” and substituting the words “ sub-regulation (5c) ”.

Rates of travelling allowance.

2. Regulation 99 of the Military Financial Regulations is amended by omitting the table in sub-regulation (1) and substituting the following table:—

Reduction of allowance where rations or quarters are provided or fare includes subsistence.

3. Regulation 101 of the Military Financial Regulations is amended by omitting the table in sub-regulation (3) and substituting the following table:—

Meal allowance.

4. Regulation 107 of the Military Financial Regulations is amended by omitting sub-regulation (2) and substituting the following sub-regulation:—

“ (2) The rates at which meal allowance is payable to a member are—

(a) for breakfast—One dollar thirty-five cents;

(b) for a mid-day meal—One dollar fifty cents; and

(c) for an evening meal—Two dollars ten cents.”.

Education allowance.

5. Regulation 131 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (2) the words “ One thousand four hundred and forty-five dollars ” and substituting the words “ One thousand five hundred and sixty dollars ”; and

(b) by omitting from paragraphs (b) and (c) of that sub-regulation the words “ Two hundred and twenty-six dollars sixty-seven cents ” and substituting the words “ Two hundred and fifty dollars ”.

Child education allowance.

6. Regulation 159 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (2) the words “ One thousand four hundred and forty-five dollars ” and substituting the words “ One thousand five hundred and sixty dollars ”; and

(b) by omitting from paragraphs (b) and (c) of that sub-regulation the words “ Two hundred and twenty-six dollars sixty-seven cents ” and substituting the words “ Two hundred and fifty dollars ”.

Rates of pay for members other than senior appointments.

7. Regulation 190 of the Military Financial Regulations is amended by omitting the table in sub-regulation (4) and substituting the following table:—

Application of amendments of, regulation 28.

8. Regulation 28 of the Military Financial Regulations as amended by these Regulations applies in relation to the service of a member on and after 15th February, 1973.

Application of amendments of regulations 99 and 101.

9. Travelling allowance is payable in accordance with regulations 99 and 101 of the Military Financial Regulations as amended by these Regulations at the rates specified in those Regulations as so amended in respect of travel on and after 2nd April, 1973.

Application of amendment of regulation 107.

10. The rates specified in regulation 107 of the Military Financial Regulations as amended by these Regulations apply in relation to meal allowance paid or payable in respect of 2nd April, 1973, or any subsequent day.

Application of amendments of regulations 131 and 159.

11. Education allowance and child education allowance are payable in accordance with the respective provisions of regulations 131 and 159 of the Military Financial Regulations as amended by regulations 5 and 6 in respect of the attendance of a child at a school during the year that commenced on 1st January, 1972, and during any subsequent year.

Application of amendment of regulation 190.

12. The rates of pay provided for in sub-regulation (4) of regulation 190 of the Military Financial Regulations as amended by regulation 7 apply in relation to the service of a member in the Papua and New Guinea Volunteer Rifles on and after 8th February, 1973.
