Overview

Statutory Rules 1969, No. 67, enacted on 1 May 1969, was introduced to address the need for updating the financial regulations within the Defence Act 1903–1966. This legislative instrument was made by the Parliament of Australia and aims to revise the pay rates, deferred pay rates, net pay rates, travelling allowances, meal allowances, and separation allowances for various ranks and stages of training within the military. The changes were designed to ensure that the financial provisions reflect contemporary standards and the evolving needs of the Defence Force, thereby providing clarity and consistency in compensation practices.

Scope and Application

Statutory Rules 1969, No. 67 pertains to the Military Financial Regulations under the Defence Act 1903–1966, specifically addressing the amendment of various rates and allowances for military personnel. This legislative instrument applies to members of the military, including apprentice tradesmen, musicians, and clerks, and officers of cadets, regulating their pay, travelling allowances, and meal allowances. The scope of the Act is national, as it applies across all states and territories within Australia, ensuring uniformity in financial regulations for military personnel. Notably, the Act provides specific rates based on rank, age, and stage of training, and includes provisions for reductions in allowances when rations, quarters, or subsistence are provided. The regulation's amendments extend to the rates of travelling allowance, meal allowance, and separation allowance, effective from the fourteenth day of February, 1969. There are no stated exclusions or exemptions within the scope of this regulation, which is enforced through the Military Financial Regulations and subordinate instruments.

Key Provisions

The Statutory Rules 1969, No. 67, under the Defence Act 1903–1966, primarily modify the Military Financial Regulations. Regulation 12 (section 1) introduces new pay rates for apprentice tradesmen and musicians, based on their training stage and age, while Regulation 99 (section 2) revises the travelling allowance rates for different military ranks, effective from the fourteenth day of February 1969. Regulation 101 (section 3) removes a previous sub-regulation that would reduce allowances if rations or quarters were provided, while adding a new sub-regulation specifying when such reductions do not apply. Furthermore, Regulation 107 (section 4) updates meal allowance rates for different meals, effective from the fourteenth day of February 1969. Finally, Regulation 226 (section 5) introduces a separation allowance for officers of cadets attending camps or courses, provided certain conditions are met. The Act imposes specific financial obligations on the military, including revised pay rates for apprentices, updated travelling allowances for officers, and new meal allowance rates. It also mandates that reductions in allowances will not apply under certain conditions and requires officers of cadets to meet specific criteria to be eligible for separation allowance. Failure to comply with the financial obligations and conditions outlined in the Act may result in financial discrepancies or eligibility issues for affected personnel. However, the specific penalties or consequences for such breaches are not detailed within the provided legislative instrument.
