Overview

Statutory Rules 1944 No. 110, made under the Defence Act 1903-1941, was enacted to address specific financial and administrative requirements within the military framework during a period of significant national and international upheaval. The regulations were issued by the Governor-General in Council and aimed to adjust the remuneration for certain high-ranking military positions. The Defence Act 1903-1941 provided the legislative foundation, allowing for the creation of detailed financial regulations to support the operational needs of the military. The policy objective was to ensure that military leaders were compensated appropriately for their roles, reflecting the importance and responsibilities of their positions. These amendments aimed to provide clarity and stability within the military hierarchy by updating financial regulations to accommodate the evolving demands of wartime leadership.

Scope and Application

This statutory instrument pertains to the Defence Act 1903-1941, with a specific focus on the amendments to the Military Financial Regulations, affecting financial aspects related to the Australian Defence Force. The regulations are applicable to officers within the military hierarchy, particularly those holding the position of Chief of the General Staff, and thus directly concern the remuneration of such high-ranking officials. The regulation sets a fixed rate of pay and an additional allowance for the Chief of the General Staff, thereby impacting financial transactions and entitlements within the Defence Force. These regulations extend throughout the Commonwealth of Australia, as they are enacted under the authority of the Australian government. The instrument does not explicitly mention exclusions or exemptions but rather focuses on the specific adjustments to the remuneration structure of the Chief of the General Staff. The regulations are an integral part of the overarching Defence Act and may be further elaborated or refined through subordinate instruments as needed to ensure compliance and effectiveness within the Defence Force.

Key Provisions

The Regulations under the Defence Act 1903-1941, specifically Statutory Rules 1944, No. 110, include amendments to the Military Financial Regulations. Firstly, regulation 27a is inserted, establishing that the Chief of the General Staff is to receive an annual salary of £1,500, in addition to a £500 annual allowance (1). Secondly, regulation 28 is amended to remove the previous salary and allowance details for the Chief of the General Staff from sub-regulation (i) and (ii) (2). These regulations impose specific financial obligations on the Commonwealth government, mandating the payment of the stated salary and allowance to the Chief of the General Staff. The amendments ensure that the compensation for this high-ranking military officer is clearly defined and consistent with the updated regulations. There are no explicit offences or penalties detailed within these regulations for non-compliance with the financial provisions. However, failure to adhere to these provisions could potentially lead to legal challenges regarding the terms of employment and compensation for the Chief of the General Staff, which may result in administrative or judicial consequences. The precise nature and extent of these consequences would depend on the specific circumstances and applicable laws at the time of any such breach.
