Overview

The Statutory Rules 1969 No. __________, made under the Defence Act 1903-1966, were enacted to amend the Military Financial Regulations, addressing the need for updated financial provisions for military personnel. The enacting body responsible for these regulations was the Governor-General in Council, acting on the advice of the Minister of State for the Army, Phillip Lynch. These regulations aim to adjust the rates of pay and allowances for various ranks within the military, ensuring that compensation remains reflective of the duties and responsibilities associated with each rank. The overarching policy objective is to maintain fair and competitive remuneration for military officers, thereby supporting the operational efficiency and morale of the Defence Force.

Scope and Application

The Statutory Rules 1969 No._________, made under the Defence Act 1903-1966, amends the Military Financial Regulations to adjust the pay rates for various ranks within the Australian Defence Force. Specifically, the regulations modify the rates for General Officers and other members, effective from 22 September 1969. The changes are applicable to members of the Permanent Military Forces and Citizen Military Forces, impacting those in the ranks of Major-General and Brigadier, with special consideration for Brigadiers who are also medical officers. The regulations ensure that any male member who held the rank of Brigadier during the specified period and is a medical officer will receive additional compensation for that tenure. The scope of these regulations is limited to the financial adjustments and does not extend to other areas of military conduct or operations.

Key Provisions

The statutory rules, made under the Defence Act 1903-1966, amend the Military Financial Regulations. Specifically, Regulation 4 modifies the allowance for special qualifications and duties, now covering regulations 31-40 (previously 30-40). Regulation 11 is amended to update the consolidated rates of pay for General Officers. The new rates are set at fifteen thousand and eighteen dollars for one rank, twelve thousand six hundred and fifty-eight dollars for another, and thirteen thousand eight hundred and thirty-eight dollars for the third. Regulation 30, concerning a special allowance for Brigadiers who are medical officers, is repealed. Regulation 190 adjusts the rates of pay for members other than senior appointments, with new rates for Major-Generals and Brigadiers specified. These amendments apply to service on or after 22 September 1969. The obligations imposed by these regulations include updating the rates of pay for specific ranks within the military forces. The regulations necessitate that the new pay rates be applied to members serving in the Permanent Military Forces and the Citizen Military Forces from the effective date of 22 September 1969. Additionally, male members of the Permanent Military Forces who held the rank of Brigadier as medical officers during the transition period are entitled to additional pay at a specified rate for that period. Compliance with these pay adjustments is mandatory for all relevant personnel within the stipulated timeframe. Failure to adhere to the amended pay rates and regulations could result in financial discrepancies and potential disputes regarding entitlements. While the statutory rules do not explicitly detail offences or penalties for non-compliance, breaches of such regulations could potentially lead to legal consequences under the Defence Act 1903-1966 or other relevant military laws. The specific penalties for such breaches would depend on the context and severity of the non-compliance, and could range from administrative sanctions to more severe disciplinary actions as prescribed by military law.
