Overview
The Statutory Rules 1977 No. 90 is a legislative instrument made under the Defence Act 1903, which governs the administration of defence matters in Australia. Enacted in 1977 by the Administrator of the Government of the Commonwealth of Australia, A. R. Cutler, with the advice of the Federal Executive Council, these regulations specifically address amendments to the Military Financial Regulations. The primary aim of these regulations is to repeal certain existing regulations, namely 271, 272, and 273, thereby streamlining and updating the financial management framework within the Defence sector. This legislative action was intended to ensure that the financial regulations remain aligned with the evolving needs and operational standards of the Australian Defence Force.
The enactment of these regulations highlights the commitment to maintaining a robust and efficient financial management system within the defence sector, ensuring that resources are allocated effectively and in compliance with legislative requirements. The policy objective behind this amendment is to facilitate smoother and more effective financial administration within the Defence Act framework, thereby supporting the overall operational readiness and effectiveness of the Australian Defence Force.
Scope and Application
The Statutory Rules 1977 No. 90, made under the Defence Act 1903, pertains to the amendment of the Military Financial Regulations, specifically repealing regulations 271, 272, and 273. This legislative instrument applies to all military personnel, defence entities, and any transactions or conduct involving financial matters within the Australian Defence Force. It has a national jurisdictional reach, affecting all operations and activities governed by the Defence Act 1903 across Australia. The regulations do not specify exclusions, exemptions, or thresholds, but they are subject to further modification or detailed application through subordinate instruments that may be issued under the Defence Act. These subordinate instruments can extend or restrict the application of the repealed regulations in various contexts or specific circumstances as deemed necessary by the relevant authorities.
Key Provisions
The key operative sections of this legislative instrument involve the amendment and repeal of specific regulations under the Military Financial Regulations. Sections 271, 272, and 273, which previously governed certain financial aspects of the military, are repealed under this regulation. This means that any provisions, rules, or directives that were outlined in these sections are no longer in effect as of the date of this regulation.
The obligations and requirements that this Act imposes on the parties or entities it governs include the need to comply with the updated or remaining regulations within the Military Financial Regulations. This means that military personnel, finance officers, and other relevant parties must now adhere to the financial rules and directives that are not covered by the repealed sections. The Act requires these individuals to stay informed about the changes and ensure that their financial practices align with the current regulations.
There are no explicit offences, penalties, or civil or criminal consequences mentioned in this particular regulation. The repeal of sections 271, 272, and 273 effectively removes the legal basis for any enforcement actions that might have been associated with these provisions. However, any failure to comply with the remaining regulations could still result in disciplinary action or other consequences as per the applicable military laws. It is important for those affected by this regulation to understand the broader legal framework within which they operate.
In summary, this legislative instrument serves to update the Military Financial Regulations by repealing specific sections and requiring affected parties to comply with the remaining regulations. While this particular regulation does not introduce new penalties or consequences, it underscores the importance of staying informed about and adhering to the financial rules governing the military.
