Overview

Statutory Rules 1937, No. 96, Regulations Under the Defence Act 1903-1934, was enacted to address the need for amendments to the Military Financial Regulations, ensuring that they align with the evolving requirements of the Australian Defence Force. The Regulations were made by the Governor-General in accordance with the Defence Act 1903-1934, with the advice of the Federal Executive Council. The objective of these regulations was to update the pay scales and allowances for certain personnel, modify the conditions under which members of the Militia Forces could be compensated for incomplete attendance at schools or courses, and redefine the winter and summer seasons for the purposes of these regulations. These amendments were necessary to ensure that the financial provisions of the Military Financial Regulations remained relevant and effective in supporting the personnel of the Australian Defence Force.

Scope and Application

The Statutory Rules 1937 No. 96, Regulations under the Defence Act 1903-1934, pertain to the amendment of specific regulations within the Military Financial Regulations. These regulations primarily concern the financial allowances and rates of pay for personnel within the Australian Army Ordnance Corps, particularly for Ordnance Mechanical Engineers, and also address allowances for members of the Militia Forces in certain circumstances. The amendments cover a range of scenarios such as the payment of allowances for members evacuated from schools or courses due to illness, those granted leave for urgent reasons, and those unable to attend due to uncontrollable circumstances. Furthermore, the regulations detail the definitions of winter and summer seasons for various military districts, which could impact financial and logistical planning within the Defence sector. These regulations apply to military personnel within the specified districts and conditions, and their implementation is a part of the broader framework established under the Defence Act 1903-1934.

Key Provisions

The main operative sections of these Regulations under the Defence Act 1903-1934 primarily concern the amendment of the Military Financial Regulations. Specifically, Regulation 33 outlines the annual rates of pay and incremental advancement for Ordnance Mechanical Engineers, categorised into four classes (Section 1). Regulation 193 is amended to allow members of the Militia Forces who are unable to complete ten working days of a school or course due to illness, urgent reasons, or uncontrollable circumstances to receive an allowance for the number of days they attended (Section 2). Additionally, Regulation 194 is modified to clarify references within the Regulations, and Regulation 240 is updated to define the winter and summer periods for different Military Districts (Sections 3 and 5). These Regulations impose certain obligations on the members of the Militia Forces and the Defence Department. Members of the Militia Forces who are unable to complete a course due to illness or other uncontrollable circumstances must provide a medical certificate or documentary evidence to receive the appropriate allowance (Section 2). Additionally, the Defence Department must adhere to the defined seasonal periods for different Military Districts when applying these Regulations (Section 5). Breach of these Regulations may result in civil or administrative consequences. For instance, failure to provide the necessary documentation for allowance claims may lead to a denial of the claim. While the Regulations themselves do not explicitly outline criminal penalties, breaches of the Defence Act 1903-1934 or related statutes may result in criminal charges, fines, or imprisonment, depending on the nature and severity of the breach. The specific penalties would be determined in the context of the broader Defence Act and applicable criminal law.
