Overview

The Statutory Rules 1968 No. __________, made under the Defence Act 1903-1966, address the need to update the rates of pay for specific classifications within the Permanent Military Forces. Enacted by the Governor-General with the advice of the Federal Executive Council, these regulations amend the Military Financial Regulations to reflect changes in pay rates for Chaplains, including the Chaplain-General, Chaplain, Third Class, and Chaplain, Fourth Class, effective from 17 July 1967. The policy objective of these amendments is to ensure equitable compensation that reflects length of service, thereby maintaining morale and attracting qualified personnel to these roles within the military structure.

Scope and Application

The Regulations under the Defence Act 1903-1966, specifically amending the Military Financial Regulations, apply to members of the Permanent Military Forces who hold the classifications of Chaplain-General, Chaplain, Third Class, and Chaplain, Fourth Class. The geographic reach of these regulations is national, as they pertain to the Commonwealth of Australia and its military forces. The regulations specify new rates of pay for these classifications, taking into account the length of service within each classification. The amended rates apply to service rendered on or after the seventeenth day of July 1967. This legislative instrument does not explicitly mention any exclusions, exemptions, or thresholds, but it does indicate that the new rates supersede any previously established rates for these classifications. The application of these regulations is confined to the financial aspects of military service and does not extend to other areas of military conduct or operations.

Key Provisions

The key provision of the Statutory Rules 1968 No._________ under the Defence Act 1903-1966 is the amendment of Regulation 12 of the Military Financial Regulations (Regulation 1(1)). Specifically, the regulation modifies the pay rates for members of the Permanent Military Forces who hold classifications such as Chaplain-General, Chaplain, Third Class, and Chaplain, Fourth Class. The new rates are detailed in a table that correlates the classification and length of service with the corresponding daily pay rate (Regulation 1(2)). This amendment applies to service rendered on or after 17 July 1967. The obligations imposed by these regulations primarily concern the financial administration within the Defence Force, particularly for chaplains. Defence Force personnel who fall under the classifications mentioned must be remunerated according to the new pay rates specified in the amended regulation. Additionally, the administration responsible for financial matters within the Defence Force is tasked with ensuring that these new rates are applied correctly and promptly to the affected personnel. Failure to comply with these regulations could result in serious consequences. While the specific penalties are not detailed in the provided text, breaches of Defence Force regulations generally attract both civil and criminal penalties. Civil penalties could include fines, while criminal penalties might encompass imprisonment, depending on the severity of the breach and the discretion of the court. The exact penalties would be determined in accordance with other relevant legislation and the specific circumstances of the breach.
