Overview
The Statutory Rules 1979 No. 131, made under the Defence Act 1903, were enacted to amend the Military Financial Regulations, specifically concerning allowances payable in respect of authorised journeys and meal allowances. These regulations were introduced to ensure that financial provisions for military personnel reflect current economic conditions and to standardise allowances across various ranks and circumstances. The enacting body was the Governor-General, acting with the advice of the Federal Executive Council. The policy objective is to provide clear and updated financial guidelines for military allowances, ensuring fairness and consistency in remuneration for authorised journeys and meals for defence personnel.
Scope and Application
These Regulations, made under the Defence Act 1903, amend the Military Financial Regulations, specifically addressing meal allowances for authorised journeys within the Australian Defence Force. The Regulations apply to authorised journeys made after 30 April 1979 and travel for which meal allowance is payable under the Military Financial Regulations, also undertaken after this date. The changes primarily involve adjustments to the monetary amounts for various meals, including breakfast, lunch, and dinner, differentiated by rank and location (capital city versus other locations). Additionally, the Regulations revise the daily meal allowance for certain travel. This legislative instrument applies across the Commonwealth of Australia, governing financial matters within the Defence Force in a manner consistent with the overarching Defence Act 1903.
Key Provisions
The Statutory Rules 1979 No. 131, made under the Defence Act 1903, introduce amendments to the Military Financial Regulations concerning meal allowances for authorised journeys. Regulation 98, which pertains to meal allowances, is amended by altering the rates for various meals and ranks (Regulation 98(a)-(d)). The amendment modifies the meal allowance table to reflect updated rates for different meals and ranks. Regulation 107 is also amended to adjust the meal allowance rates for lunch and dinner (Regulation 107(b)-(c)). These changes apply to authorised journeys and travel undertaken after 30 April 1979.
These regulations impose specific obligations on the parties involved. The updated meal allowance rates must be applied to authorised journeys and travel undertaken post 30 April 1979. This includes ensuring that the correct meal allowance amounts are paid according to the amended tables in Regulations 98 and 107. Parties responsible for processing and paying these allowances must adhere to the new rates specified in the regulations.
Failure to comply with these regulations could result in financial discrepancies or incorrect payments. While the legislation does not explicitly outline specific penalties for non-compliance, any breaches could potentially lead to administrative or legal consequences. The exact consequences would depend on the context and severity of the non-compliance, potentially involving audits, financial reviews, or corrective actions. It is important for parties involved to ensure they are aware of and follow the updated regulations to avoid any such issues.
