Overview
Statutory Rules 1964 No. 133, made under the Defence Act 1903-1956, was enacted to address the need for updating financial regulations concerning allowances for military personnel, specifically parachutists. This legislative instrument was formulated by the Deputy of the Governor-General, acting on the advice of the Federal Executive Council. The regulation amends the Military Financial Regulations, specifically updating the parachutists’ allowance by adjusting monetary values to reflect changes in currency and economic conditions. The policy objective of these amendments is to ensure that military personnel receive appropriate financial support commensurate with their duties and the prevailing economic environment.
Scope and Application
The Statutory Rules 1964 No. 133, made under the Defence Act 1903-1956, pertain to amendments in the Military Financial Regulations concerning allowances for parachutists. These regulations apply specifically to the financial compensation provided to parachutists, adjusting the monetary amounts for specific allowances effective from the fourth day of August 1964. The amendments involve updating the financial figures from shillings to shillings and pence, thereby reflecting an increase in the rates payable to parachutists. The application of these amendments is limited to the financial allowances for parachutists and does not extend to other personnel or categories within the Defence Force. The regulations are issued by the Deputy of the Governor-General, acting on advice from the Federal Executive Council, thereby establishing their authority within the Commonwealth of Australia. There are no stated exclusions, exemptions, or thresholds within the scope of these regulations, and they do not extend or restrict application through subordinate instruments.
Key Provisions
The main operative sections of this legislative instrument are the amendments to Regulation 30 of the Military Financial Regulations. Specifically, Regulation 30(2)(a) to (d) are being altered to adjust the rates of parachutists' allowance. These changes involve altering specific monetary amounts to new values, such as changing "Five shillings" to "Five shillings and sixpence" in section (a), and similarly adjusting other values in sections (b), (c), and (d). The new values are to apply from 4 August 1964 onwards.
These amendments impose specific obligations on the parties governed by the Military Financial Regulations. The changes mean that, from the effective date, the allowances payable to parachutists under the Military Financial Regulations must be adjusted to reflect the new monetary values specified. This ensures that the financial support provided to military personnel engaged in parachuting duties is updated to match the new rates.
Failure to comply with these regulations could result in legal consequences. Although the specific consequences are not outlined in the legislative instrument, generally, non-compliance with financial regulations in a military context can lead to disciplinary actions against military personnel and financial penalties. The precise nature of the penalties would depend on the severity and intent behind the breach, as well as other relevant military regulations and disciplinary procedures.
