Migratory Birds (Amendment) Ordinance 1988

An Ordinance to amend the Migratory Birds Ordinance 1980
Short title
1. This Ordinance may be cited as the Migratory Birds (Amendment) Ordinance 1988.1
Principal Ordinance
2. In this Ordinance, “Principal Ordinance” means the Migratory Birds Ordinance 1980.2
Interpretation
3. Section 3 of the Principal Ordinance is amended:
(a) by omitting from subsection (1) the definition of “Agreement”; and
(b) by omitting subsection (2).
Permits to take birds
4. Section 4 of the Principal Ordinance is amended by omitting from paragraph (5) (e) “, being a purpose consistent with the Agreement”.
Permits for purchase of birds
5. Section 10 of the Principal Ordinance is amended by omitting from paragraph (5) (d) “, being a purpose consistent with the Agreement”.
Regulations
6. Section 25 of the Principal Ordinance is amended by omitting from subsection (2) “that is not consistent with the Agreement” and substituting:
“unless the Minister considers that that purpose is consistent with international agreements relating to the protection of migratory birds, birds in danger of extinction and their environmnet, as in force from time to time, to which Australia is a party”.

7. Schedule 1 to the Principal Ordinance is repealed.

8. Schedule 3 to the Principal Ordinance is repealed and the following Schedule substituted:
