EXPLANATORY STATEMENT
Migration Regulations 1994
CLASS OF PERSONS
(PARAGRAPH 1218(3)(d))
- This Instrument is made under paragraph 1218(3)(d) of the Migration Regulations 1994 (“the Regulations”).
2. Paragraph 1218(3)(d) of the Regulations provides that internet applications for Tourist visas may be made if, and only if, the applicant is in a class of persons specified in an instrument in writing for the purposes of this paragraph.
3. The purpose of the Instrument is to allow the Delegate to specify which classes of people are eligible to make an application for a Tourist visa (Subclass 676) over the internet.
4. The Instrument operates by specifying classes of persons who are eligible to make an application for a Tourist visa over the internet via form 48. These specified classes of persons are defined either as holders of specified passports, or as holders of specified passports who apply through approved travel agencies. Persons who do not fall into a class specified in the Instrument are not able to lodge a valid application for a Tourist visa via the internet lodgement facilities.
5. The Instrument extends access to internet applications for citizens of Chile, and to citizens of Turkey who hold a Diplomatic, Service or Special passport.
6. Consultation is unnecessary as, under section 18(1) of the Legislative Instruments Act 2003, the Instrument is of a minor or machinery nature and does not substantially alter existing arrangements.
7. The Office of Best Practice Regulation has advised that a Regulatory Impact Statement is not required (OBPR Ref 12488).
