Overview
The Migration Regulations 1994 were enacted to provide a comprehensive framework for the administration of Australia's migration laws, including the regulation of visa applications. In 2006, an instrument was introduced to address the specific issue of tourist visa applications from citizens of the People’s Republic of China. This instrument was designed to specify which areas within China are eligible for the Approved Destinations Status (ADS) scheme, thereby broadening the scope of travel agents that can participate in this scheme. The policy objective was to facilitate increased participation from Chinese travel agents, potentially enhancing the tourism industry by allowing more regions in China to be part of the ADS scheme. The instrument was made under the general power to specify matters by way of Gazette Notice and operates to list all provinces, municipalities and autonomous regions in Mainland China as specified areas for the purposes of paragraph 676.214(a) of the Regulations. This initiative was undertaken following consultations with relevant stakeholders including the China National Tourism Authority and the Australian Department of Industry, Tourism and Resources.
Scope and Application
The Instrument made under the Migration Regulations 1994 aims to extend the scope of tourist visa applications from citizens of the People’s Republic of China by specifying additional areas within Mainland China from which applications can be made. This is achieved through a Gazette Notice under Regulation 1.17 and paragraph 676.214(a) of the Regulations, which mandates that applicants must be residents of specified areas in the PRC. The Instrument lists all provinces, municipalities, and autonomous regions in Mainland China, thus broadening the eligibility criteria for the Approved Destinations Status (ADS) scheme. By doing so, it facilitates increased participation of Chinese travel agents in the ADS scheme, thereby impacting the tourism industry. The commencement of this Instrument on 28 February 2006 indicates its immediate applicability to the specified areas, enhancing the regulatory framework governing tourist visa applications from China.
Key Provisions
The key provisions of this Instrument, made under Regulation 1.17 and Paragraph 676.214(a) of the Migration Regulations 1994, establish the specific areas in the People's Republic of China (PRC) from which tourist visa applications can be made. According to Regulation 1.17 (1), the Instrument specifies these areas by way of Gazette Notice, while Paragraph 676.214(a) mandates that the applicant must be a resident of one of the specified areas in the PRC (2, 3). The purpose of this Instrument (IMMI06/002), which came into effect on 28 February 2006, is to enumerate all provinces, municipalities, and autonomous regions in Mainland China as the specified areas for tourist visa applications (3, 6). This move is designed to facilitate the participation of more Chinese travel agents in the Approved Destinations Status (ADS) scheme in China (4).
The obligations and requirements imposed by this Instrument are primarily aimed at ensuring that only individuals who reside in the specified areas in Mainland China can apply for tourist visas under the ADS scheme. This requirement is a crucial aspect of the regulations governing the migration process for Chinese citizens applying for tourist visas. The listing of all provinces, municipalities, and autonomous regions in Mainland China as specified areas ensures clarity and accessibility for potential applicants and travel agents participating in the ADS scheme (3).
Failure to comply with the provisions of this Instrument could result in serious consequences. While the specific offences, penalties, or civil/criminal consequences for breach are not detailed in the explanatory statement, it is clear that any non-compliance with the residency requirement specified in Paragraph 676.214(a) could lead to the rejection of a tourist visa application. Additionally, any misrepresentation or fraudulent activity related to the residency requirement could result in more severe penalties, potentially including criminal charges and fines. The explanatory statement does not provide specific details on the maximum penalties, but it is reasonable to assume that they would be in line with the penalties outlined in the Migration Regulations 1994 for similar offences.
