EXPLANATORY STATEMENT
Migration Regulations 1994
POST OFFICE BOX AND COURIER ADDRESSES
(VARIOUS PROVISIONS OF SCHEDULE 1 TO THE REGULATIONS)
- This Instrument is made under regulation 1.17 and various provisions of Schedule 1 to the Migration Regulations 1994 (‘the Regulations’).
2. Section 1.17 of the Regulations provides that the Minister may, by notice published in the Gazette, specify matters required by individual provisions of the Regulations to be specified for the purposes of those provisions.

Subparagraphs 1128AA(3)(aa)(i), 1128B(3)(aa)(i), 1128BA(3)(h)(i), 1128C(3)(aa)(i), 1128CA(3)(c)(i), 1128D(3)(aa)(i), 1134(3)(b)(i), 1212A(3)(j)(i), 1218A(3)(b)(i), 1226(3)(b)(i) of Schedule 1 to the Regulations provide that an application for a General Skilled Migration visa can be made by posting the application (with correct pre-paid postage) to the post office box address specified by the Minister in a Gazette Notice.

Subparagraphs 1128AA(3)(aa)(ii), 1128B(3)(aa)(ii), 1128BA(3)(h)(ii), 1128C(3)(aa)(ii), 1128CA(3)(c)(ii), 1128D(3)(aa)(ii), 1134(3)(b)(ii), 1212A(3)(j)(ii), 1218A(3)(b)(ii), 1226(3)(b)(ii) of Schedule 1 to the Regulations provide that an application for a General Skilled Migration visa can be made by having the application delivered by a courier service to the address specified by the Minister in a Gazette Notice.
5. The purpose of the Instrument is to ensure that applications for General Skilled Migration (GSM) visa subclasses, including the Skilled – Designated Area-sponsored (Provisional)(Class UZ) and Skilled – Designated Area-sponsored (Residence)(Class CC) visas which are to be introduced on 1 July 2006, are delivered by post or courier to a particular location for processing.
6. The Instrument operates to specify the post office box address and address for courier service that applications for GSM visas are to be delivered to.
7. Pursuant to section 18 of the Legislative Instruments Act 2003 consultation was not necessary. The Instrument is of a minor or machinery nature and does not substantially alter existing arrangements.
8. The Instrument, IMMI 06/040, commences on 1 July 2006.
