Overview

The Migration Regulations 1994, as updated by the legislative instrument F2014L01031, address the need to streamline the process of lodging visa applications by specifying particular post office box and courier addresses for certain visa categories. This legislative update was introduced to ensure clarity and efficiency in the visa application process, particularly for Temporary Graduate (Subclass 485) and Skilled – Recognised Graduate (Subclass 476) visas. By revoking the previous instrument IMMI 13/144, this update removes outdated references to other visa subclasses that are no longer applicable. The instrument was enacted by the relevant authority under the Legislative Instruments Act 2003 and aims to maintain streamlined administrative procedures without necessitating consultation or a Regulatory Impact Statement due to its minor nature. This update ensures that the visa application process remains current and efficient for applicants.

Scope and Application

The Migration Regulations 1994, as amended by the legislative instrument F2014L01031, establish specific post office box and courier addresses for the submission of applications related to Temporary Graduate (Subclass 485) visas and Skilled – Recognised Graduate (Subclass 476) visas. This regulation applies to applicants of these particular visa subclasses and removes any references to other skilled migration visa subclasses such as 175, 176, 475, 487, 885, and 886, which are no longer applicable for new applications. The regulation is designed to streamline the visa application process by clearly designating where applications should be sent, ensuring they reach the appropriate department for processing. This amendment does not require consultation as it is deemed to be of a minor or machinery nature, and it does not substantially alter existing arrangements. Furthermore, the regulation exempts itself from disallowance and does not necessitate a Regulatory Impact Statement or a Statement of Compatibility with Human Rights.

Key Provisions

The primary operative sections of this Instrument, as specified in paragraphs 1228(3)(a) and 1229(3)(c) of the Migration Regulations 1994, are designed to update the addresses where applications for Temporary Graduate (Subclass 485) and Skilled – Recognised Graduate (Subclass 476) visas should be lodged. These sections specifically revoke the previous Instrument IMMI 13/144 (F2013L02046) and establish new post office box and courier addresses for the specified visa applications. Additionally, this Instrument removes references to other skilled migration visa subclasses such as 175, 176, 475, 487, 885 and 886, reflecting that applications for these visas are no longer accepted. The obligations imposed by this Instrument require applicants for the Temporary Graduate (Subclass 485) and Skilled – Recognised Graduate (Subclass 476) visas to lodge their applications at the newly specified post office box and courier addresses. This ensures that applications are directed to the correct and current processing locations, facilitating efficient handling and compliance with the visa application process. It is important that applicants meticulously follow these directives to avoid delays or potential issues with their visa applications. There are no specific offences, penalties, or consequences mentioned within the text of this Instrument for failing to adhere to the specified lodgement requirements. However, in general terms, non-compliance with visa application processes can lead to administrative delays, potential refusal of the visa application, or other repercussions as outlined in the broader Migration Act 1958 and associated regulations. It is crucial for applicants to ensure they submit their applications correctly to avoid any adverse outcomes.
