Overview

The Migration Act 1958 is a foundational piece of Australian legislation governing the entry, stay, and departure of people from Australia. Enacted to provide a comprehensive framework for managing immigration, the Act addresses various aspects of migration, including visa applications, residency, and deportation. One aspect of the Act's regulatory framework is detailed in the Migration Regulations 1994, which were amended to specify addresses for postal and courier delivery of certain immigration-related documents. The legislative instrument F2006B00218, dated 26 September 2002, specifies particular addresses for the Perth Office Processing Centre, effective from 1 November 2002. This was enacted under the authority of the Minister for Immigration and Multicultural and Indigenous Affairs, Philip Ruddock, to ensure clarity and efficiency in the submission of immigration applications by setting explicit addresses for postal and courier services as required by paragraph 1124(3)(aa) of the Regulations. The policy objective of this legislative instrument is to streamline the processing of immigration applications by providing clear and accessible addresses for document submission.

Scope and Application

The Migration Act 1958, as amended and regulated by the Migration Regulations 1994, governs the specified post office box and courier delivery address for particular application submissions. This legislative instrument, issued under the authority of the Minister for Immigration and Multicultural and Indigenous Affairs, designates the Perth Office Processing Centre's Locked Bag 7, Northbridge, WA 6865, as the post office box address and its physical address at 411 Wellington Street, Perth, WA 6000, as the courier delivery address for applications pursuant to subparagraph 1124(3)(aa). These addresses are to be used for applications requiring submission by post or courier as stipulated by the Regulations, effective from 1 November 2002. The instrument delineates the specific addresses required for compliance with the Act and its Regulations, thereby ensuring that applications are submitted to the correct locations as per the legislative requirements.

Key Provisions

The legislative instrument F2006B00218, issued under the Migration Act 1958 and the Migration Regulations 1994, specifies particular addresses for the submission of applications. According to section 1, the Minister for Immigration and Multicultural and Indigenous Affairs, Philip Ruddock, has designated a post office box address (Perth Office Processing Centre, Locked Bag 7, NORTHBRIDGE WA 6865) for subparagraph 1124(3)(aa)(i) of the Regulations. This address is for postal submissions of applications. Concurrently, section 2 designates a physical address (Perth Office Processing Centre, 411 Wellington Street, PERTH WA 6000) for subparagraph 1124(3)(aa)(ii) for applications delivered via courier services. This specification came into effect from 1 November 2002. The obligations imposed by this legislation on applicants are straightforward. For subparagraph 1124(3)(aa)(i), applicants must post their applications to the specified post office box address. For subparagraph 1124(3)(aa)(ii), applicants must ensure their applications are delivered by a courier service to the designated physical address. These requirements ensure that all applications are routed through the correct channels and processed efficiently by the relevant authorities. Failure to adhere to the specified addresses for submission could result in complications or delays in processing applications. However, the legislative instrument does not explicitly state any offences, penalties, or specific civil or criminal consequences for non-compliance with these address requirements. It is understood that not following these directions might lead to administrative issues, but the precise repercussions are not detailed in this particular notice.
