Overview

The Migration Regulations 1994, which were enacted to regulate the migration of individuals into Australia and the conditions under which they may stay, address the need for streamlined processes and clear guidelines for various visa applications. One such regulation, specifically under Schedule 1, mandates that applications for Special Eligibility visas and Distinguished Talent visas must be submitted to a designated address, as specified in a Gazette Notice. This regulation ensures that applicants know precisely where to submit their applications, maintaining a consistent and organised process for the Department of Immigration and Multicultural and Indigenous Affairs (DIMIA). To keep the process up-to-date, an explanatory statement was issued on 26 April 2005, updating the postal and courier delivery addresses for these visa applications, reflecting the relocation of the Australian Capital Territory (ACT) and Regions Office. This ensures that applicants are aware of the new locations where they must lodge their applications to avoid any processing delays.

Scope and Application

The Migration Regulations 1994, as amended by this Instrument, apply specifically to applicants for Special Eligibility visas and Distinguished Talent visas, ensuring they are aware of the correct postal and courier delivery addresses for their applications. This change comes into effect from 26 April 2005, when the Australian Capital Territory (ACT) and Regions Office relocates, necessitating a revision of the addresses where these specific visa applications must be lodged. Applicants are required to post their applications to the new address, Special Migration Application, GPO Box 717, Canberra ACT 2601, or deliver them by courier to Special Migration Application, DIMIA, 3 Lonsdale Street, Braddon ACT 2612. This Instrument does not affect the broader business environment or restrict competition, hence no consultation was deemed necessary under the Legislative Instruments Act 2003.

Key Provisions

The primary operative sections of the notice pertain to the addresses where Special Eligibility visas and Distinguished Talent visas applications must be lodged. Specifically, under Items 1112(3)(a), 1113(3)(aa), 1115(3)(a), and 1118(3)(a) of the Migration Regulations 1994, applicants are mandated to submit their applications to the addresses specified in the notice. Effective from 26 April 2005, these applications must be sent to GPO Box 717, Canberra ACT 2601, AUSTRALIA by post, or delivered by courier to Special Migration Application, DIMIA, 3 Lonsdale Street, BRADDON ACT 2612, AUSTRALIA. The notice imposes clear obligations on applicants for Special Eligibility visas and Distinguished Talent visas. It mandates that from 26 April 2005, all applications for these visas must be lodged at the new specified addresses. Failure to comply with these directives could result in the applications not being processed or being returned to the applicant, potentially causing delays or other complications in the visa application process. There are no direct offences, penalties, or civil/criminal consequences outlined in the notice itself for failing to comply with the address requirements. However, any adverse outcomes resulting from non-compliance, such as delays or rejections of visa applications, would be handled under the general provisions of the Migration Act 1958 and the Migration Regulations 1994. These might include the possibility of an applicant needing to reapply, potentially incurring additional costs and time delays.
