EXPLANATORY STATEMENT
Migration Regulations 1994
ORGANISATIONS THAT MAY SPONSOR SHORT STAY BUSINESS VISITORS
(REGULATION 459.214(c))
- This Instrument is made under regulation 1.17 and paragraph 459.214(c) of Schedule 2 to the Migration Regulations 1994 (‘the Regulations’).
2. Regulation 1.17 of the Regulations provides that the Minister may, by notice published in the Gazette, specify matters required by individual provisions of the Regulations to be specified for the purposes of those provisions. The Minister’s power was delegated under regulation 1.17 to make notices specifying organisations for the purposes of paragraph 459.214(c) of Schedule 2 to the Regulations to the First Assistant Secretary of Migration and Temporary Entry Division.
3. Paragraph 459.214(c) of Schedule 2 of the Regulations provides that an applicant for a Sponsored Business Visitor (Short Stay) (Subclass 459) visa may be sponsored by an organisation specified in a Gazette Notice for the purposes of that paragraph.
4. The purpose of the Instrument is to specify the organisations that may sponsor an applicant for a Sponsored Business Visitor (Short Stay) visa.
5. The Instrument operates to add Success Group International Pty Ltd, Australia NUR The Light Foundation Inc, AAC Group Pty Ltd, Equinix Australia Pty Ltd, Fiji Senior Citizens Satsang Association of Queensland Inc and IOR Research & Technology Pty Ltd to the list of organisations that may sponsor short stay business visitors to come to Australia to undertake genuine business-related activities.
6. As this Instrument is likely to have a direct, or substantial indirect, effect on business, external consultations were previously undertaken with Success Group International Pty Ltd, Australia NUR The Light Foundation Inc, AAC Group Pty Ltd, Equinix Australia Pty Ltd, Fiji Senior Citizens Satsang Association of Queensland Inc and IOR Research & Technology Pty Ltd.
7. The Instrument, IMMI 07/015, commences on the day after registration on the Federal Register of Legislative Instruments.
