Overview

The Migration Regulations 1994 were enacted to provide a comprehensive framework for the regulation of migration into Australia, addressing the need for streamlined and orderly procedures for various types of visas, including temporary and skilled visas. This legislative instrument, specifically F2013L00533, was introduced under Subitem 1229(1) of the Migration Regulations 1994 to specify the forms that applicants must use for the Temporary Graduate (Subclass 485) Visa. The instrument was developed to ensure clarity and efficiency in the application process for both the Post-Study Work stream and the Graduate Work stream within the Temporary Graduate visa. The enacting body for this instrument is the Australian Government, with the aim of maintaining a structured and accessible application process for eligible international graduates seeking to work in Australia temporarily after completing their studies.

Scope and Application

The Migration Regulations 1994 Forms for the Temporary Graduate (Subclass 485) Visa (F2013L00533) applies specifically to applicants seeking to obtain a Temporary Graduate (Subclass 485) Visa under the Migration Regulations 1994. This legislative instrument mandates the forms that must be used by applicants for both the Post-Study Work stream and the Graduate Work stream within the Temporary Graduate visa. The forms specified are essential for making a valid application, ensuring that all necessary information is captured as required by the Minister. The regulation operates on a national level and applies to all individuals and entities involved in the visa application process, with no exemptions or exclusions outlined in this particular instrument. While the instrument itself does not substantially alter existing arrangements and is exempt from disallowance, it is integral to the administrative process of applying for the subclass 485 visa.

Key Provisions

The key operative sections of this legislation pertain to the forms required for applications for the Temporary Graduate (Subclass 485) Visa. According to Subitem 1229(1) of the Migration Regulations 1994, applicants must submit their applications on the forms specified by the Minister. This instrument identifies the specific form numbers for both paper and internet applications for the Post-Study Work stream and the Graduate Work stream within the Temporary Graduate (Subclass 485) visa. These forms are essential to ensure that applications are processed correctly and efficiently. The Migration Regulations 1994 impose several obligations on the parties involved in the visa application process. Applicants for the Temporary Graduate (Subclass 485) Visa must use the specified form numbers to make a valid application. This requirement ensures that all necessary information is provided in a standardised format, facilitating the assessment process by immigration authorities. Additionally, the Minister's authority to specify these forms underscores the importance of adhering to the prescribed application procedures. Failure to comply with the form requirements set out in this legislation may result in significant consequences. Applications that do not use the specified forms may be deemed invalid, potentially leading to delays or outright rejection of the visa application. While the specific penalties for such breaches are not detailed in this instrument, it is generally understood that non-compliance with visa application requirements can lead to civil or criminal penalties, including fines or imprisonment, under the broader Migration Act 1958. This instrument, IMMI 13/014, commences on 23 March 2013, following the commencement of the Migration Legislation Amendment Regulation 2013 (No. 1). This timing ensures that applicants are aware of the new form requirements immediately upon the regulation's effective date. As the instrument is of a minor or machinery nature and does not substantially alter existing arrangements, it was exempt from the requirement for a Regulatory Impact Statement or a Human Rights Statement of Compatibility. Additionally, consultation was not necessary pursuant to subsection 18(1) of the Legislative Instruments Act 2003, given the minor nature of the changes.
