EXPLANATORY STATEMENT

 

Migration Regulations 1994

 

FORMS FOR THE TEMPORARY GRADUATE (SUBCLASS 485) VISA

 (Subitem 1229(1))

 

 

  1. This Instrument is made under Subitem 1229(1) of the Migration Regulations 1994 (‘the Regulations’).

 

2.                  Subitem 1229(1) of the Regulations provides that applications for Skilled (Provisional) (Class VC) visas must be made on the form or forms specified by the Minister in an instrument in writing.

 

3.                  The purpose of the Instrument is to specify the form numbers for paper and internet forms that applicants must use to make a valid application for the Temporary Graduate (Subclass 485) Visa.

 

4.                  The instrument operates to provide details of the form numbers that must be used by applicants for the Post-Study Work stream and the Graduate Work stream within the Temporary Graduate (Subclass 485) visa.

 

5. Pursuant to subsection 18(1) of the Legislative Instruments Act 2003 consultation was not necessary.  The Instrument is of a minor or machinery nature and does not substantially alter existing arrangements.

 

6. The Office of Best Practice Regulation has advised that a Regulatory Impact Statement is not required (OBPR Reference 14502).

 

7. Under section 44 of the Legislative Instruments Act 2003 the Instrument is exempt from disallowance and therefore a Human Rights Statement of Compatibility is not required.

 

8. The instrument, IMMI 13/014, commences on 23 March 2013, immediately after the commencement of Migration Legislation Amendment Regulation 2013 (No. 1).
