Overview

The Commonwealth of Australia's Migration Regulations 1994 were enacted to provide the framework for the administration of the Migration Act 1958, ensuring that immigration processes are conducted in a systematic and orderly manner. The specific legislative instrument F2005B02591 addresses a gap in the application process for the Subclass 416 (Special Program) visa by specifying particular addresses to which applicants must submit their applications according to different methods. Enacted under the authority of the Minister for Immigration and Multicultural and Indigenous Affairs, Amanda Vanstone, this instrument was designed to streamline the visa application process by clearly delineating where and how applications should be sent, thus reducing confusion and ensuring that applications are received at the correct location. The policy objective is to facilitate a more efficient and accessible application process for those seeking special program visas.

Scope and Application

The legislative instrument F2005B02591, specifying addresses for the purposes of subparagraphs 1205(3)(ba)(i), (ii) and (iii) of the Migration Regulations 1994, applies to individuals who seek to meet the criteria for the grant of a Subclass 416 (Special Program) visa. These regulations are applicable across the Commonwealth of Australia, administered by the Minister for Immigration and Multicultural and Indigenous Affairs. The specified addresses, including a post office box and physical address in Hobart, as well as a fax number, are designated for the submission of visa applications as per the stipulated subparagraphs of the Regulations. This instrument effectively delineates the precise locations where such applications should be posted, delivered, or sent via facsimile to ensure compliance with the regulatory requirements. The legislation does not explicitly mention any exclusions or exemptions, and its application is restricted to the prescribed methods of application submission for the specified visa subclass.

Key Provisions

The Migration Regulations 1994, under subparagraphs 1205(3)(ba)(i), (ii), and (iii), provide specific requirements for the submission of applications for a Subclass 416 (Special Program) visa. As per these subparagraphs, the application can be made by posting it to a specified post office box address (subparagraph 1205(3)(ba)(i)), by delivering it via a courier service to a designated address (subparagraph 1205(3)(ba)(ii)), or by faxing it to a specified number (subparagraph 1205(3)(ba)(iii)). The recent legislative instrument, effective from 1 July 2004, specifies these addresses and the fax number for the purposes of these subparagraphs, ensuring applicants know where to submit their applications. The obligations imposed by the Regulations require applicants for the Subclass 416 visa to adhere to the specified submission methods. Specifically, for subparagraph 1205(3)(ba)(i), applicants must post their application with the correct pre-paid postage to the post office box address at GPO Box 794, Hobart TAS 7001. For subparagraph 1205(3)(ba)(ii), the application must be delivered by a courier service to the address at Level 13, 188 Collins Street, Hobart TAS 7000. Lastly, for subparagraph 1205(3)(ba)(iii), the application must be sent via fax to the number 61 3 6223 8247. These obligations ensure that all applications are received at the correct locations and in the correct format. Failure to comply with the specified submission methods outlined in the Regulations can result in the application being deemed invalid. There are no explicit offences or penalties stated within the legislative instrument for incorrect submission methods, but the invalidity of the application could lead to delays or denials in the visa process. It is crucial for applicants to carefully follow the specified requirements to avoid any potential issues with their applications.
