Overview

The Migration Regulations 1994, as amended by the instrument F2014L00980, introduced the specification of Bupa Medical Visa Services as a health service provider under subregulation 1.15AA(2). This legislative update was enacted to address the need for continuity in processing health assessments for carer visa applications following the repeal of the Carer Visa regulations. The objective of this instrument, which operates to specify Bupa for the purposes of the carer definition, is to ensure that the relative in Australia who has the medical condition requiring a carer can still undertake the necessary medical assessment by a designated health service provider. The instrument was made under the authority of the Legislative Instruments Act 2003 and was exempt from disallowance and the requirement for a Regulatory Impact Statement, as it was deemed of minor or machinery nature and did not substantially alter existing arrangements. The instrument commenced on 21 July 2014.

Scope and Application

The Instrument, F2014L00980, specifies Bupa Medical Visa Services as a health service provider for the purposes of the carer definition in regulation 1.15AA of the Migration Regulations 1994. This designation is crucial for the processing of medical assessments required for the relative in Australia who has a medical condition necessitating a carer. The Regulations mandate that such assessments must be conducted by a health service provider specified by the Minister, and this Instrument serves to formally recognise Bupa in this capacity. The Instrument is particularly relevant for ongoing applications that remain in the pipeline following the repeal of the Carer Visa regulations. The commencement of the Instrument on 21 July 2014 ensures that the necessary health assessments can continue to be processed without interruption. The Instrument is of a minor or machinery nature, exempt from disallowance, and does not require a Regulatory Impact Statement or a Human Rights Statement of Compatibility.

Key Provisions

The Migration Regulations 1994 (Health Service Provider) Instrument 2014 (F2014L00980) designates Bupa Medical Visa Services as a health service provider under subregulation 1.15AA(2) of the Regulations (paragraph 2). This designation is in response to the need for relatives in Australia who have medical conditions requiring a carer to undergo a medical assessment by a specified health service provider (paragraph 3). Given that the Carer Visa regulations have been repealed, this instrument ensures that health assessments can still be processed for existing applications that are ongoing (paragraph 3). This designation is a formal recognition of Bupa’s role in conducting the necessary medical assessments for visa applicants, ensuring compliance with the legal requirements established by the Regulations. The Act imposes certain obligations on Bupa as the designated health service provider. Primarily, Bupa must conduct the medical assessments for relatives in Australia who need a carer as part of the visa application process (subregulation 1.15AA(2)). These assessments must be performed in accordance with the requirements set out in the Migration Regulations 1994. Bupa is also required to ensure that all assessments are completed in writing, as stipulated by the Regulations (subregulation 1.15AA(2)). Additionally, Bupa must maintain the confidentiality and integrity of the assessment process, adhering to the standards expected of a health service provider under Australian law. Failure to comply with the requirements outlined in the Instrument may result in legal consequences. While specific penalties are not detailed in the Explanatory Statement, breaches of the Regulations could lead to actions under the Migration Act 1958. Such actions may include the cancellation of visas, fines, or other administrative penalties. Given the minor nature of the Instrument, it is likely that any breaches would be addressed under the existing provisions of the Migration Act, which may include civil or administrative penalties for non-compliance with visa assessment requirements.
