EXPLANATORY STATEMENT
Migration Regulations 1994
HEALTH SERVICE PROVIDER
(Subregulation 1.15AA(2))
- This Instrument is made under subregulation 1.15AA(2) as kept in force by Part 30 of Schedule 13 to the Migration Regulations 1994 (‘the Regulations’).
2. The purpose of the Instrument is to specify Bupa Medical Visa Services (‘Bupa’) as a health service provider under subregulation 1.15AA(2).
3. The Instrument operates to specify Bupa as a health service provider for the purposes of the carer definition in regulation 1.15AA kept in force by Part 30 of Schedule 13 to the Regulations. The Regulations require the relative in Australia who has the medical condition giving rise to the need for a carer to undertake a medical assessment by a health services provider specified by the Minister in an Instrument in writing. As the Carer Visa regulations have been repealed the instrument is required to enable health assessments to be processed for remaining applications that are in the pipeline.
4. Pursuant to subsection 18(1) of the Legislative Instruments Act 2003 consultation was not necessary. The Instrument is of a minor or machinery nature and does not substantially alter existing arrangements.
5. The Office of Best Practice Regulation has advised that a Regulatory Impact Statement is not required (OBPR Reference 16953).
6. Under section 44 of the Legislative Instruments Act 2003 the Instrument is exempt from disallowance and therefore a Human Rights Statement of Compatibility is not required.
7. The Instrument commences on 21 July 2014.
