Overview

The Migration Regulations 1994 were enacted to provide a framework for the administration of Australia's migration laws. The specific problem or legislative gap addressed by the 2005 Notice, F2005L01621, is the expansion of eligibility for online applications for a Tourist visa (subclass 676) to include additional countries. This Notice was introduced to streamline the application process for eligible tourists by allowing them to apply for their visas via the Internet, thereby enhancing efficiency and accessibility. The Notice was made under the authority of the Minister for Immigration and Citizenship, pursuant to section 1.17 and paragraph 1218(3)(d) of the Regulations. The policy objective of this legislative instrument is to facilitate the application process for eligible tourists from specified countries, ultimately promoting tourism while ensuring that the application process remains secure and manageable.

Scope and Application

The explanatory statement for the Migration Regulations 1994 Notice specifies that the regulations aim to determine the eligibility criteria for individuals to apply for a Tourist visa (subclass 676) via the Internet. This applies to individuals who hold a passport from one of the specified countries or regions detailed in the schedule of the Gazette. The specified countries include Andorra, Austria, Belgium, Brunei, Canada, Denmark, Finland, France, Germany, Greece, Hong Kong Special Administrative Region People’s Republic of China, Iceland, Republic of Ireland, Italy, Japan, Republic of Korea, Liechtenstein, Luxembourg, Malaysia, Malta, Monaco, The Netherlands, Norway, Portugal, Republic of San Marino, Singapore, Spain, Switzerland, Sweden, United Kingdom of Great Britain and Northern Ireland, United States of America, Vatican City, and others. The inclusion of these countries is subject to any conditions outlined in the schedule. The instrument was made following consultation with relevant stakeholders, including the Department of Industry, Tourism and Resources, Tourism Australia, and various industry stakeholders through the Tourism and Visa Advisory Group process. The Notice commences on 1 July 2005, and its application extends to those individuals who meet the specified passport criteria.

Key Provisions

The main operative sections of the instrument include section 1.17 of the Migration Regulations 1994, which empowers the Minister to specify certain matters required by individual provisions of the Regulations. Specifically, the instrument specifies the class of persons who are eligible to apply for a Tourist visa (subclass 676) via the Internet under paragraph 1218(3)(d). This is achieved by listing the countries and regions whose passport holders are eligible to apply online, subject to any conditions specified in the schedule of the Gazette Notice. The eligible countries and regions include Andorra, Austria, Belgium, Brunei, Canada, Denmark, Finland, France, Germany, Greece, Hong Kong Special Administrative Region People’s Republic of China, Iceland, Republic of Ireland, Italy, Japan, Republic of Korea, Liechtenstein, Luxembourg, Malaysia, Malta, Monaco, The Netherlands, Norway, Portugal, Republic of San Marino, Singapore, Spain, Switzerland, Sweden, United Kingdom of Great Britain and Northern Ireland, United States of America, Vatican City, in addition to those already specified, namely the United Arab Emirates, Bahrain, the Republic of Cyprus, the Czech Republic, Estonia, Hungary, Kuwait, Latvia, Lithuania, Oman, Poland, Qatar, Slovakia and Slovenia. The instrument imposes obligations on the applicants for a Tourist visa (subclass 676) by stipulating that only those persons who hold a passport from one of the specified countries or regions are eligible to apply online. The eligibility is subject to any conditions outlined in the schedule of the Gazette Notice. For instance, if an applicant holds a passport from a country listed in the schedule but does not meet the conditions specified in the third column, they would not be eligible to apply for the visa online. This requirement ensures that only those who meet the specified criteria can use the online application process, thereby streamlining the visa application process for eligible applicants. Breach of the conditions specified in the instrument, or misrepresentation of eligibility, could result in civil or criminal consequences. While the specific offences, penalties, or consequences for breach are not detailed in the explanatory statement, it is known that breaches of the Migration Regulations can lead to penalties. For instance, making a false statement in a visa application can result in a civil penalty of up to $27,500 for individuals and $137,500 for bodies corporate, as well as potential criminal penalties. The maximum penalty for a criminal offence under the Migration Act can include imprisonment for up to 10 years, particularly for serious offences such as human trafficking or people smuggling. Therefore, applicants must ensure they meet all eligibility criteria and provide accurate information to avoid any potential legal repercussions.
