Overview
The Migration Legislation Amendment (Information and Other Measures) Act 2007 was enacted to address gaps and limitations in the access and disclosure of personal identifying information, such as photographs or signatures, within the context of immigration. This Act, which received Royal Assent on 15 April 2007, amends the Migration Act 1958, the Environment Protection and Biodiversity Conservation Act 1999, the Fisheries Management Act 1991, and the Torres Strait Fisheries Act 1984, to better align and streamline the personal identifier provisions across these Acts. The Act was introduced by the Australian Parliament and aims to ensure that the relevant authorities have the necessary tools to appropriately manage and disclose personal information while maintaining the integrity and security of the information. The amendments came into effect on 1 May 2007, as fixed by the subsequent Proclamation.
Scope and Application
The Migration Legislation Amendment (Information and Other Measures) Act 2007 applies to the Migration Act 1958, the Environment Protection and Biodiversity Conservation Act 1999, the Fisheries Management Act 1991, and the Torres Strait Fisheries Act 1984, primarily in the context of access to and disclosure of identifying information such as photographs or signatures. This legislation is designed to address certain limitations within these Acts concerning personal identifiers, especially as they pertain to immigration. The amendments made by this Act are intended to ensure that the relevant authorities can properly access and use such personal identifiers in accordance with the requirements of the specified Acts. The scope of the Act covers both individuals and entities subject to these legislative provisions, particularly those involved in immigration processes and those whose activities are regulated under the named Acts. The Act applies on a Commonwealth level and its provisions are designed to harmonise and update the treatment of personal identifiers across the specified legislative frameworks. The application of the Act is subject to any commencement provisions stipulated within the amending Act, with the Proclamation setting 1 May 2007 as the effective date for Part 1 of Schedule 1 to the amending Act.
Key Provisions
The key operative sections of the Migration Legislation Amendment (Information and Other Measures) Act 2007, as detailed in Schedule 1, primarily address amendments to existing legislation concerning personal identifier provisions. Specifically, section 2(1) of the amending Act amends the Migration Act 1958, the Environment Protection and Biodiversity Conservation Act 1999, the Fisheries Management Act 1991, and the Torres Strait Fisheries Act 1984 to modify how identifying information, such as photographs or signatures, is accessed and disclosed in the immigration context. These changes were intended to address limitations and ensure compliance with updated standards and practices. The commencement of these amendments was set by Proclamation, which designated 1 May 2007 as the effective date, as detailed in Item 2 of the table in subsection 2(1) of the amending Act.
The obligations and requirements imposed by this Act on the parties or entities it governs primarily revolve around the revised handling of personal identifier information. For example, under the amended Migration Act 1958, there are new stipulations on how personal photographs or signatures are collected, stored, and disclosed, with a focus on ensuring that these actions are in line with privacy standards and legislative requirements. Similarly, the Environment Protection and Biodiversity Conservation Act 1999, the Fisheries Management Act 1991, and the Torres Strait Fisheries Act 1984 have been updated to reflect these changes, ensuring that any personal identifier information collected for immigration purposes adheres to the new legislative framework. These obligations necessitate that relevant authorities and entities review and update their processes and systems to comply with the amended provisions.
Breaches of the provisions outlined in the Migration Legislation Amendment (Information and Other Measures) Act 2007 may result in various civil or criminal consequences. For example, if an entity fails to comply with the new requirements for the access and disclosure of personal identifier information, they could be subject to penalties under the respective amended Acts. While the specific penalties are detailed within the individual Acts, the overarching framework ensures that non-compliance is taken seriously, with potential sanctions including fines or other legal actions. The precise penalties would depend on the specific Act under which the breach occurred and the nature and severity of the violation.
