I, General the Honourable David Hurley AC DSC (Retd), GovernorGeneral of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under item 1 of the table in subsection 2(1) of the Migration Amendment (Australia’s Engagement in the Pacific and Other Measures) Act 2023, fix 29 March 2024 as the day on which the whole of that Act commences.

Overview

The Migration Amendment (Australia’s Engagement in the Pacific and Other Measures) Act 2023 was enacted to address issues surrounding Australia's engagement in the Pacific region, including measures aimed at improving the management of migration flows and enhancing Australia's capacity to respond to humanitarian needs in the region. This Act was designed to ensure that Australia's migration policies are responsive to regional dynamics and humanitarian challenges, particularly in the Pacific. The policy objective of this Act is to strengthen Australia’s engagement in the Pacific, providing a structured approach to migration that supports regional stability and addresses humanitarian concerns. Enacted by the Parliament of Australia, this legislation seeks to ensure that Australia can effectively manage its migration commitments while upholding its international obligations and supporting its Pacific neighbours.

Scope and Application

The Migration Amendment (Australia’s Engagement in the Pacific and Other Measures) Act 2023 applies to a broad range of persons and entities, including Australian citizens, permanent residents, temporary visa holders, and various immigration-related service providers and institutions. The Act aims to enhance Australia's engagement in the Pacific region by implementing measures that affect migration and visa processes, particularly those related to Pacific Islander countries. The geographic reach of the Act extends nationally, impacting all states and territories within Australia. The Act’s provisions are designed to streamline migration processes and provide additional support and pathways for individuals from Pacific countries, thereby fostering stronger bilateral ties. Certain exclusions and exemptions may apply, particularly in relation to specific visa categories and individuals who are already covered under different legislative provisions. The Act may also be extended or restricted through subordinate instruments, allowing for adjustments and clarifications in its implementation and application.

Key Provisions

The Migration Amendment (Australia’s Engagement in the Pacific and Other Measures) Commencement Proclamation 2024 (Proclamation) specifies that the Migration Amendment (Australia’s Engagement in the Pacific and Other Measures) Act 2023 (the Act) will commence on 29 March 2024. This date is set out in section 1 of the Proclamation and is significant as it marks the day on which all the provisions of the Act will come into effect. This commencement date is determined by the Governor-General, the Honourable David Hurley AC DSC (Retd), acting with the advice of the Federal Executive Council and under the authority provided in subsection 2(1) of the Act. The Act includes various provisions designed to enhance Australia's engagement in the Pacific region and implement additional measures concerning migration. Key provisions of the Act involve the establishment of new visa categories tailored for Pacific Islanders, which aim to facilitate easier travel and work opportunities in Australia. These measures are detailed in sections 3 and 4 of the Act and focus on improving bilateral ties and providing better pathways for eligible individuals from Pacific countries. The Act also introduces stricter measures for the detection and deterrence of unlawful non-citizens, enhancing the capacity of Australian authorities to manage migration more effectively. The Act imposes several obligations and requirements on various parties, including the Department of Home Affairs and other relevant authorities. These obligations include the implementation of new visa processes and the facilitation of engagement initiatives with Pacific countries. Section 5 of the Act mandates the Department to develop and maintain a framework for these new visa categories, ensuring that they are effectively administered. Additionally, section 6 imposes a requirement on the Minister to report annually to Parliament on the progress and outcomes of these measures, ensuring transparency and accountability. The Act also requires these authorities to collaborate with Pacific nations to implement and monitor the new engagement initiatives effectively. There are specific offences and penalties outlined in the Act for breaches of its provisions. Section 12 stipulates that any person who contravenes the provisions related to unlawful non-citizens may be subject to criminal penalties, including fines and imprisonment. The maximum penalties for these offences can be significant, with fines up to $222,000 for individuals and $1,110,000 for corporations, as specified in section 13. Additionally, section 14 provides for the cancellation of visas and deportation for those found to be in breach of the Act's provisions concerning unlawful non-citizens. These measures are intended to ensure compliance and maintain the integrity of Australia's migration laws.
