MIGRATION AGENTS

(CONTINUING PROFESSIONAL DEVELOPMENT –

AUTHORSHIP AND PUBLICATION OF ARTICLES)

 

MARA NOTICE 37 OF 2003

 

 

The Migration Agents Registration Authority, acting under clause 3 of Schedule 1 to the Migration Agents Regulations 1998:

 

(1)               REVOKES the notice entitled Migration Agents (Continuing Professional

Development - Authorship and Publication of Articles) MARA Notice 28 of 2003, published on 9/07/2003; and

 

(2) SPECIFY that the authorship and publication of a detailed article of at least 1,000 words in a journal or magazine described in column 2 of an item in the attached Schedule is an approved activity for the purposes of that clause and that that activity is:

 

 (a) a core activity having the value of 1 point, if the article;
 

(i) relates specifically to the Migration Act 1958, the Migration Regulations and other legislation relating to migration procedure or migration portfolio policies and procedures; and
 

(ii)                contributes in a positive manner to the development and practice of immigration law; and
 

(iii)              has not been previously published in substantially the same form; and
is not the published version of a paper, or of papers, presented at another approved activity for which the author has been awarded a point; or

 

 (b) an elective activity having the value of 1 point, if the article:
 

(i) deals with a topic of a legal or business nature relating to migration agents’ practice; and
 

(ii)                complies with subparagraphs 2(a) (i), (ii) and (iii).

 

This notice has effect on and from 1 April 1998.

Overview

The Migration Agents Registration Authority (MARA) Notice 37 of 2003 amends the Migration Agents Regulations 1998 to address a gap in the continuing professional development requirements for migration agents in Australia. This notice was enacted to provide clarity on what constitutes an approved activity for migration agents to fulfil their professional development obligations.
