Overview

The Australian National University Membership of the Council Rules 2013 were enacted to establish the methods of election and terms of office for the members of the University's Council, in accordance with the Australian National University Act 1991. This legislation was introduced to address the need for clear and transparent procedures governing the composition and governance of the University's Council. The enacting body for these rules is the Council of the Australian National University itself, exercising its authority under section 12 of the Membership of the Council Statute 2010. The overarching policy objective of the Rules is to ensure the proper functioning and accountability of the Council by clearly defining how its members are elected and the duration of their terms of office.

Scope and Application

The Australian National University Membership of the Council Rules 2013 governs the procedures for the election of council members under specific provisions of the Australian National University Act 1991. These rules apply to the members of the council of the Australian National University and those involved in the election processes as stipulated in paragraphs 10(1)(k), (l), (m), and (n) of the Act. The rules set out the methods of election and the maximum term of office for certain members, thereby providing a clear framework for the governance structure of the university council. The rules apply nationally within the jurisdiction of the Australian National University and are subordinate to the overarching legislative framework provided by the Australian National University Act 1991. Notably, the rules do not incorporate any external documents by reference and were made by the Council of the University on 26 July 2013. This legislative instrument does not specify any exclusions, exemptions, or thresholds, and any extensions or restrictions to its application would be governed by the Act itself or any future amendments to it.

Key Provisions

The Australian National University Membership of the Council Rules 2013 sets out the procedures and criteria for the election of Council members under the Australian National University Act 1991. Section 10(1)(k) to (n) of the Act specifies the categories of members to be elected: academic, staff, and student members. The Rules detail the methods of election for these members, including the nomination process, eligibility criteria, and the voting procedure (sections 4 to 12). Additionally, the Rules establish the maximum term of office for certain members, ensuring a structured and timely rotation of council positions (section 13). The Rules impose several obligations on the parties involved in the election process. Firstly, they require the Council to establish a nomination committee to oversee the nomination and election process (section 4). This committee must ensure that all nominations are made in accordance with the eligibility criteria specified in the Rules (section 5). Furthermore, the Rules mandate that all elections be conducted in a fair and transparent manner, with detailed guidelines on how votes are to be cast and counted (sections 6 to 8). The Rules also outline the responsibilities of the returning officer, who is responsible for the administration of the elections and ensuring compliance with the stipulated procedures (section 9). Failure to comply with the provisions of the Rules can lead to various consequences. While the Rules themselves do not explicitly state penalties for non-compliance, breaches of the Australian National University Act 1991 or associated policies could result in disciplinary action against individuals or entities involved. Such actions might include fines, suspension, or removal from office, depending on the severity of the breach and the governing body’s discretion. Additionally, legal action might be pursued in cases of significant non-compliance, resulting in civil or criminal penalties as determined by the relevant court or tribunal. The specific penalties would be in line with the broader legislative framework governing the university’s operations.
