Overview

The Medicare Guarantee (2019-20 Credit No. 1) Determination 2019 was enacted in 2019 by JOSH FRYDENBERG, the Treasurer, under section 7 of the Medicare Guarantee Act 2017. This legislation was introduced to address the need for financial stability and assurance within the healthcare system, particularly by ensuring that there are sufficient funds available in the Medicare Guarantee Fund to meet the demands of the Australian population. The policy objective of this determination is to credit a specific amount to the Medicare Guarantee Fund (Treasury) Special Account, which was established under the Act, thereby reinforcing the financial underpinnings of the Medicare system and safeguarding it against potential shortfalls. The determination is a notifiable instrument as defined by the Legislation Act 2003, highlighting its importance in the legislative framework.

Scope and Application

The Medicare Guarantee (2019-20 Credit No. 1) Determination 2019, made under section 7 of the Medicare Guarantee Act 2017, applies to the allocation of funds within the Medicare Guarantee Fund (Treasury) Special Account, established by the Act, for the specified budget year commencing 1 July 2019. This determination ensures the crediting of an amount of $36,567,354,000.00 to the Medicare Guarantee Fund (Treasury) Special Account to support the operations and obligations of the Medicare system. The Act itself, while not explicitly detailing the application to specific persons, entities, or industries, broadly applies to all matters related to the Medicare Guarantee Fund and its management within the Australian jurisdiction. Given its Commonwealth nature, the Act's jurisdiction spans across Australia, with its application extending through subordinate instruments as necessary. The determination itself does not specify any exclusions or exemptions, implying a comprehensive application unless otherwise stipulated by the Act or further legislative instruments.

Key Provisions

The Medicare Guarantee (2019-20 Credit No. 1) Determination 2019 (paragraph 1) is the specific legislative instrument that mandates the crediting of funds into the Medicare Guarantee Fund (Treasury) Special Account. This determination, which takes effect the day after its creation (paragraph 2), is made under the authority of section 7 of the Medicare Guarantee Act 2017 (paragraph 3). The key provision of this determination is the crediting of a specified amount of $36,567,354,000.00 to the Medicare Guarantee Fund (Treasury) Special Account at the start of 1 July 2019, for the budget year beginning on that date (paragraph 4). The Medicare Guarantee (2019-20 Credit No. 1) Determination 2019 imposes obligations on the Treasurer, who is responsible for ensuring the timely crediting of the specified amount to the Medicare Guarantee Fund (Treasury) Special Account. This crediting is essential to maintain the financial health of the fund, which supports the Medicare system in Australia. The Treasurer must ensure that the funds are transferred accurately and on time, in accordance with the provisions of the determination. Under the Medicare Guarantee (2019-20 Credit No. 1) Determination 2019, there are no explicit offences or penalties for non-compliance mentioned in the text. However, the failure to comply with the requirements of this determination could potentially have serious implications for the funding and operation of the Medicare system. It is likely that any non-compliance would be subject to the general provisions of the Medicare Guarantee Act 2017, which may include civil or administrative penalties for breaches of the Act or its associated legislation. In summary, the Medicare Guarantee (2019-20 Credit No. 1) Determination 2019 sets out the requirement for the crediting of $36,567,354,000.00 to the Medicare Guarantee Fund (Treasury) Special Account, with the Treasurer responsible for ensuring the timely transfer of funds. While there are no explicit penalties mentioned in the text, failure to comply with the determination could have significant consequences for the Medicare system.
