Overview
The Medical Research Future Fund Act 2015 was enacted to establish a fund dedicated to the advancement of medical research in Australia, aiming to ensure a sustainable source of funding for future research initiatives. The Act was introduced to address the need for a long-term financial commitment to medical research, which is critical for improving health outcomes and fostering innovation in healthcare. This legislation was enacted by the Australian Parliament, reflecting a policy objective to secure the nation's health future through strategic investment in medical research. The Act provides the framework for the establishment and management of the Medical Research Future Fund, including the crediting of amounts to the Fund. One of the key provisions of the Act allows the responsible Ministers to determine specific amounts to be credited to the Fund, as outlined in the Medical Research Future Fund (Crediting of Amounts) Determination 2015 (No. 1), which mandates the crediting of $2,139,351,000 to the Fund on 1 December 2015.
Scope and Application
The Medical Research Future Fund (Crediting of Amounts) Determination 2015 (No. 1) applies to the Medical Research Future Fund Special Account, which is established under the Medical Research Future Fund Act 2015. This determination, issued by the responsible Ministers, mandates the crediting of a specified amount to the Medical Research Future Fund Special Account on a designated date. The Act itself applies to the Commonwealth of Australia, and the determination is a legislative instrument that is not subject to disallowance under the Legislative Instruments Act 2003. The amount to be credited consists of savings from the Health portfolio and the final balance of the abolished Health and Hospitals Fund, after certain expenses are met. The determination came into effect on the day it was registered on the Federal Register of Legislative Instruments and does not require a Regulatory Impact Statement as the impact of the changes is minor.
Key Provisions
The Medical Research Future Fund (Crediting of Amounts) Determination 2015 (No. 1) serves a crucial function under the Medical Research Future Fund Act 2015, specifically section 15(1)(a), by mandating the crediting of a specific amount to the Medical Research Future Fund Special Account. The determination requires that the sum of $2,139,351,000 be credited to this account on 1 December 2015. This amount is derived from realised savings from the Health portfolio, amounting to $2,109,851,000, and the final balance of the abolished Health and Hospitals Fund, which is $29,500,000, after accounting for the remaining expenses of the Future Fund Board of Guardians.
The obligation imposed on the responsible Ministers under this determination is to ensure that the specified amount is credited to the Medical Research Future Fund Special Account on the specified date. This involves a formal process of transferring funds from the designated sources to the account as outlined. The determination is also subject to the provisions of section 15(3) of the Act, which stipulates that it is a legislative instrument for the purposes of the Legislative Instruments Act 2003, although it is not subject to disallowance under section 42 of that Act. The commencement of this determination is governed by its registration on the Federal Register of Legislative Instruments.
In terms of compliance and consequences, there are no explicit offences or penalties outlined in the determination itself. However, failure to comply with the determination's requirements could potentially lead to broader legal or administrative repercussions under the overarching Medical Research Future Fund Act 2015. The determination is designed to ensure the timely and accurate crediting of funds to the Medical Research Future Fund Special Account, thereby supporting the objectives of the Act. The determination's legislative nature and the absence of disallowance provisions underscore the importance of adherence to the specified financial processes and timelines.
