Overview
The Meat Export Control (Fees and Expenses) Regulations 1936 were enacted under the authority of the Meat Export Control Act 1935-1936 by the Governor-General in Council, reflecting the Commonwealth of Australia's intent to regulate the fees and expenses associated with the administration of meat export control. This legislative instrument was introduced to address the need for structured compensation and reimbursement policies for the officials involved in the meat export regulatory process. The policy objective is to ensure that the officials responsible for overseeing meat exports are fairly compensated for their time and travel expenses, thus maintaining an effective and efficient regulatory framework without unduly burdening the public purse. This regulation specifically excludes parliamentarians from receiving certain allowances to prevent potential conflicts of interest.
Scope and Application
The Meat Export Control (Fees and Expenses) Regulations, made under the Meat Export Control Act 1935-1936, specify the financial entitlements and reimbursements for members and the Chairman of the Board involved in the regulation of meat exports. These regulations delineate that they do not apply to the Chairman of the Board or any of its members, or their deputies, if they are members of Parliament at either the Commonwealth or state level. The Chairman is entitled to a fee of four pounds four shillings per day for attending Board or committee meetings, whereas other members or their deputies receive two pounds two shillings per day for the same attendance. Should a member travel more than fifteen miles to a meeting, they are eligible for an additional allowance of two pounds two shillings per day for travel expenses, alongside the applicable meeting fee, unless they already receive a fee for that day. Furthermore, members are reimbursed for their return travel fares from their residence to the meeting location, with the caveat that any airfare exceeding the cost of rail or steamer travel is only reimbursable with ministerial approval.
Key Provisions
The Meat Export Control (Fees and Expenses) Regulations, made under the Meat Export Control Act 1935-1936, outline the financial entitlements for members of the Board and related committees. These regulations, which came into effect on the 1st of April 1936, provide specific provisions for fees and travel allowances. Firstly, section 3 establishes that the Chairman of the Board is entitled to a fee of Four pounds four shillings per day, while each member or deputy of a member attending Board or Committee meetings is entitled to Two pounds two shillings per day for their attendance. It is important to note that if a member attends both a Board meeting and a Committee meeting on the same day, they are entitled to only one fee (section 3).
Secondly, section 4 details the travel allowances. Members residing more than fifteen miles from the meeting location can claim an allowance of Two pounds two shillings per day to cover travel expenses related to attending meetings. However, if a member receives a daily fee for their attendance, they are not entitled to the travel allowance for that day (section 4(1)). Additionally, members are reimbursed for the actual return travel fares from their residence to the meeting location, provided that if they travel by air and the fare exceeds the amount payable for rail or steamer travel, they are only reimbursed for the lesser amount unless approved by the Minister (section 4(2)).
Thirdly, these regulations impose certain obligations on the parties they govern. The Board and its members must accurately claim their entitled fees and travel allowances as per the regulations. The Board must ensure that any travel expenses claimed are reasonable and necessary and comply with the stipulated conditions regarding travel by air. The Minister has the authority to review and approve any expenses that exceed the prescribed limits.
The consequences of non-compliance with these regulations are not explicitly stated in the text, but breaches of similar regulations typically result in penalties. Such penalties may include financial penalties, recoupment of improperly claimed allowances, and potential disciplinary action against the offending parties. The severity of these consequences would depend on the nature and extent of the breach.
