Overview

The Meat Chicken Levy Collection Act 1969 was enacted to address the need for a systematic collection of levies on meat chickens hatched at hatcheries. The Act, established by the Australian Parliament, aims to ensure that levies on meat chickens are collected efficiently and transparently, thereby supporting the industry's financial obligations and regulatory compliance. The accompanying Meat Chicken Levy Collection Regulations 1969 provide detailed instructions on the process of levy collection, including the appointment of authorized agents, the manner of levy payment, and the requirement for hatcheries to submit accurate returns. These regulations are designed to streamline the levy collection process, ensuring that all stakeholders comply with the legislative requirements while maintaining proper records of their activities.

Scope and Application

The Meat Chicken Levy Collection Regulations, made under the Meat Chicken Levy Collection Act 1969, apply to persons who operate hatcheries that hatch meat chickens, specifically those who have carried on business as a hatchery proprietor during any month to which these regulations apply. These regulations mandate the payment of levies or other amounts payable to the Commonwealth, which must be made to the Collector of Public Moneys, Department of Primary Industry at Canberra. Hatchery proprietors are required to submit a return in accordance with Form 1 before the expiration of two months after the last day of the applicable month, detailing the number of meat chickens hatched, those that died or were destroyed within 48 hours after hatching, and other relevant statistics. Additionally, these regulations stipulate that proper records must be kept, including the number of eggs set in incubators, the number of chickens hatched, and the method of disposal for chickens that were not sold before one month old. The regulations also allow for the appointment of authorized agents to execute declarations on behalf of the hatchery proprietor. These regulations have a national reach within the Commonwealth of Australia and are applicable from the month of July 1969 onwards.

Key Provisions

The Meat Chicken Levy Collection Regulations, made under the Meat Chicken Levy Collection Act 1969, lay out specific requirements for the collection of levies on meat chickens. Regulation 3 specifies that any levies payable to the Commonwealth relating to meat chickens hatched at a hatchery must be paid to the Collector of Public Moneys, Department of Primary Industry at Canberra. Regulation 4 mandates that the proprietor of a hatchery must submit a return to the Secretary to the Department of Primary Industry at Canberra within two months after the end of each relevant month. This return must detail the number of meat chickens hatched, including those that died or were destroyed within 48 hours of hatching, and those sold or otherwise disposed of before reaching one month of age. Regulation 5 requires hatcheries to maintain detailed records, including the number of eggs set in incubators, the total number of meat chickens hatched, and the number of non-meat chickens hatched, among other specifics. These Regulations impose certain obligations on the proprietors of hatcheries. Firstly, they must ensure that any applicable levies are paid to the specified government department. Secondly, they must submit accurate and timely returns detailing the hatch statistics as outlined. Thirdly, they must maintain comprehensive records for the period following the commencement of these Regulations. Additionally, hatcheries have the option to appoint an authorized agent, as per Regulation 6, who can execute the declaration in Form 1 on their behalf. This appointment must be made in accordance with Form 2 and lodged with the Secretary to the Department of Primary Industry at Canberra. Failure to comply with these Regulations may result in civil consequences. Specifically, Regulation 5 imposes a penalty of two hundred dollars for any non-compliance in maintaining proper records. The Regulations do not explicitly detail other potential penalties or consequences for breaches such as failure to submit timely returns or pay the correct levies, but such breaches could lead to further enforcement actions by the relevant authorities.
