Marine Orders, Part 59

(Offshore support vessel operations)

Issue 1

Order No 10 of 1997

 

 

Authority

 

 1. Section 425(1) of the Navigation Act 1912  (the Act) empowers the Governor-General to make regulations necessary or convenient for carrying out or giving effect to the Act.

 2. Section 425 (1AA) of the Act allows the Australian Maritime Safety Authority (the Authority) to make orders with respect to matters in Part VB of the Act in relation to which provision may be made by regulations.

 3. Marine Orders, Part 59, Issue 1, was made pursuant to subsection 425(1AA).

 

 

Purpose

 

 4. Marine Orders Part 59, Issue 1:

 

 5. Marine Orders Part 59, for the purposes of the Navigation Act 1912, provides for safe navigation and a safe system of operations involving the transfer of persons or goods, to or from, offshore industry vessels and off-shore industry mobile units.

 6. Businesses affected by the changes have been fully consulted through appropriate industry associations.

 

Overview

 

 7. Marine Orders Part 59 specifies a code of practice for safe navigation and a safe system of operations involving the transfer of persons or goods, to or from, off-shore industry vessels and off-shore industry mobile units.  Part 59 takes account of requirements specific to the Australian off-shore support vessel industry.

 

 

Contents of the Order

 

 8. Provision 1 provides interpretations necessary for proper understanding of the Order.

 

 9. Provision 2 indicates the purpose for which this Order has been made.

 

10. Provision 3 specifies those vessels and off-shore units to which the provisions of this Part applies.

 

11. Provision 4 specifies, for the purposes of the Navigation (Orders) Regulations, the provisions of Part 59 that are penal provisions

 

12. Provision 5 provides for the master’s and crew’s responsibilities in relation to the safe arrangements of off-shore support operations. Compliance with this provision may be achieved by adopting practices that conform with the designated industry code of safe practice.
