Marine Orders, Part 1 — Incidental Marine Order

Order No. 9 of 2008
Purpose
- Marine Orders, Part 1 — Incidental Marine Order gives effect to a decision of the Chief Executive Officer of the Australian Maritime Safety Authority (‘AMSA’) to redesignate the position of General Manager, Maritime Operations as Deputy Chief Executive Officer, Maritime Operations.
- The redesignation of this position is to take effect on and from 1 October 2008.
Power
3. Subsection 425 (1) of the Navigation Act 1912 (‘the Act’) empowers the Governor-General to make regulations necessary or convenient for carrying out or giving effect to the Act.
4. Subsection 425 (1AA) of the Act provides that AMSA may make orders with respect to any matter for or in relation to which regulations may be made.
5. Marine Orders Part 1, Issue 1 is empowered by, and made pursuant to, subsection 425 (1AA) of the Act.
Consultation
6. As Marine Orders Part 1, Issue 1 relates to an administrative decision of AMSA, it was considered unnecessary to circulate it for comment.
Provision commencing on 1 October 2008
Provision 1
7. Provision 1 of Marine Orders Part 1, Issue 1, provides that a reference to the General Manager, Maritime Operations is also taken to be a reference to the Deputy Chief Executive Officer, Maritime Operations.
8. A note following provision 1 sets out the Parts of Marine Orders that refer to the General Manager, Maritime Operations at the time of making Marine Orders Part 1, Issue 1.
