LONG SERVICE LEAVE (COMMONWEALTH EMPLOYEES) REGULATIONS (AMENDMENTS)

Issued with the authority of the Public Service Board

Section 26 of the Long Service Leave (Commonwealth Employees) Act 1976 (the Act) provides that the Governor-General may make regulations prescribing all matters which are required or permitted to be prescribed, or which are necessary or convenient to be prescribed, for carrying out or giving effect to the Act.

Section 8 of the Act enables the regulations to provide that allowances of specified kinds are to be included in salary for the purposes of the Act or of a provision of the Act.

The statutory rules insert a new regulation 4DB which provides that tool allowances are to be included in salary for the purposes of the Act. Tool allowance is paid to staff for supplying and maintaining tools and equipment ordinarily required in the performance of their work.
