This legislative instrument was developed under section 282-30 of the Private Health Insurance Act 2007 by the Commonwealth Parliament to ensure timely and accurate reporting of private health insurance information. The primary objective is to facilitate compliance by mandating that specific information be reported within a set timeframe, thereby supporting the administrative oversight of private health insurance funds. The impact of this instrument is deemed to be minimal in terms of compliance costs, and it is considered routine in nature. The instrument was subject to significant consultation with Medicare and the health industry, ensuring its practicality and effectiveness in fulfilling its legislative purpose.

Scope and Application

The legislative instrument F2013L00627 pertains to the lodgment of private health insurance information in accordance with the Private Health Insurance Act 2007. It applies to the Chief Executive of Medicare who must report specific information regarding individuals who were members of complying private health insurance funds during each financial year. This information must be reported to the Commissioner of Taxation within a specified timeframe. The scope of this instrument is primarily within the Commonwealth jurisdiction, given its association with the Commonwealth legislative framework. There are no stated exclusions or exemptions in this instrument, and it does not mention any thresholds that would limit its application. The instrument may be extended or modified through subordinate legislation, consistent with the requirements of the Legislative Instruments Act 2003. This instrument has been developed to ensure accurate reporting of private health insurance information, facilitating compliance with the Private Health Insurance Act 2007. The instrument is considered routine and has minimal compliance costs, as evidenced by the consultation with Medicare and the health industry which began on 20 April 2012.

Key Provisions

The primary operative sections of this legislative instrument, as per section 282-30 of the Private Health Insurance Act 2007, detail the specific information that must be reported to the Commissioner of Taxation by the Chief Executive of Medicare regarding individuals who were members of complying private health insurance funds during each financial year. This instrument, which came into effect on 1 June 2013, is designed to ensure the timely and accurate reporting of this information within a predetermined period. The purpose of this instrument, as outlined in section 5, is to specify the details of the private health insurance statement information that needs to be reported and the deadline for lodging it. In terms of obligations and requirements, the Act imposes on the Chief Executive of Medicare the duty to report detailed information about the insured individuals to the Commissioner of Taxation. This information must be reported within a specific timeframe, ensuring that the Commissioner has up-to-date data to manage and monitor the private health insurance system effectively. The instrument has been developed to facilitate compliance with these reporting obligations, ensuring that all necessary data is collected and submitted promptly. Regarding the consequences for non-compliance, the instrument itself does not explicitly state any penalties or consequences for failing to report the required information. However, it is important to note that non-compliance with reporting obligations under the Private Health Insurance Act 2007 may lead to administrative actions or penalties under the broader provisions of the Act. Such penalties could include fines or other corrective measures aimed at enforcing compliance with the statutory requirements. Additionally, the legislative instrument is compatible with human rights as it does not engage any of the applicable rights or freedoms. The instrument simply provides guidance on the information required to be lodged and the period by which it must be lodged, without raising any human rights issues. This compatibility ensures that the reporting requirements do not infringe upon the rights and freedoms of individuals who are insured under complying private health insurance funds.
