Overview

The Local Government (Transition) (Amendment) Ordinance (No. 3) 1992 was enacted to address certain transitional issues in the local government framework on Christmas Island. This legislation was introduced to amend the Local Government (Transition) Ordinance 1992, ensuring a smoother transition of governance structures. The enacting body for this Ordinance was the Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, under the authority granted by the Christmas Island Act 1958. The primary objective of this amendment was to temporarily suspend specific provisions of the Local Government Act, ensuring continuity and stability during the transitional phase of local governance on the island. This was achieved by omitting certain subparagraphs and inserting new provisions that suspended the operation of particular sections until the end of June 1993.

Scope and Application

The Local Government (Transition) (Amendment) Ordinance (No. 3) 1992 applies to the Territory of Christmas Island and is designed to make specific amendments to the Local Government (Transition) Ordinance 1992. This legislative instrument was made under the authority of the Christmas Island Act 1958, which grants the power to enact ordinances for the governance of the territory. The ordinance specifically addresses the suspension of certain provisions of the Local Government Act until the end of 30 June 1993. These provisions include subsection 53(2) and Division 4 of Part XXV of the Local Government Act, which are temporarily deactivated during this period. The ordinance thus applies to the local government authorities within Christmas Island and directly affects their operational framework by suspending specified sections of the Local Government Act for a defined time.

Key Provisions

The Local Government (Transition) (Amendment) Ordinance (No. 3) 1992 (section 2) amends the Local Government (Transition) Ordinance 1992, which itself is a transitional legislation designed to manage the shift from federal administration to local governance on Christmas Island. The primary changes introduced by this amendment relate to the suspension of certain provisions of the Local Government Act. Specifically, subparagraphs 8(b)(iii) and 8(b)(iv) of the original ordinance are omitted (section 3.1), and a new subparagraph is inserted after 8(b), suspending the operation of subsection 53(2) and Division 4 of Part XXV of the Local Government Act until the end of 30 June 1993 (section 3.2). Under the amended ordinance, certain provisions of the Local Government Act are suspended, effectively delaying their implementation until June 1993. This includes the suspension of subsection 53(2) and Division 4 of Part XXV, which likely pertain to specific operational or procedural aspects of local government functions. The intent behind this suspension appears to be to allow for a smooth transition period without immediately enforcing these provisions, possibly due to logistical or administrative considerations. Entities governed by the Local Government Act, such as the local council and associated administrative bodies, are required to adhere to the amended provisions as set out in the ordinance. This includes recognising the suspension of certain provisions until 30 June 1993 and ensuring that their operations do not conflict with this temporary suspension. The obligation on these entities is to maintain operational continuity while respecting the transitional nature of the local government framework on Christmas Island during this period. The ordinance does not explicitly outline specific offences, penalties, or consequences for breaches of the suspension provisions. However, any failure to comply with the suspended provisions before the specified date of 30 June 1993 could potentially lead to legal challenges or administrative actions under the broader Local Government Act or other relevant laws. The precise nature and severity of such consequences would depend on the specific circumstances and the applicable legal framework at the time.
