Overview

The Live-stock Slaughter Levy Collection Act 1964 was enacted to establish a mechanism for the collection of levies on livestock slaughtered at abattoirs. This Act, together with the Live-stock Slaughter Levy Collection Regulations, was introduced to ensure that levies imposed on livestock slaughter are effectively collected and managed. The Regulations, which were made under the authority of the Act on 17 July 1964 and notified in the Commonwealth Gazette on 20 July 1964, specify the procedures for the payment of levies, the submission of returns, the appointment of authorized agents, and the maintenance of proper records by abattoir proprietors. The primary objective of this legislation is to facilitate the systematic collection of levies for livestock slaughter, ensuring compliance and accountability within the industry.

Scope and Application

The Live-stock Slaughter Levy Collection Regulations, made under the Live-stock Slaughter Levy Collection Act 1964, specify the administrative and procedural aspects of levy collection for livestock slaughtered at abattoirs across Australia. These regulations apply to proprietors of abattoirs in each State and Territory of Australia, mandating the submission of monthly returns detailing the number of livestock slaughtered, their types, and the applicable levies. Payment of the levy and other amounts is to be made to the Collector of Public Moneys, Department of Primary Industry, at designated locations listed in the First Schedule. The regulations also allow for the appointment of authorized agents to manage these submissions on behalf of the abattoir proprietors, with such appointments and returns to be lodged with the relevant Collector of Public Moneys. Furthermore, abattoir proprietors are required to maintain proper records of livestock slaughtered, including the number of carcases exceeding specified weights, and furnish statements of this information when requested by those causing the livestock to be slaughtered. The regulations do not explicitly state any exclusions, exemptions, or thresholds, other than the weight specifications for categorizing carcases, and they extend their application through the use of forms and schedules detailed in the Second Schedule.

Key Provisions

The Live-stock Slaughter Levy Collection Regulations, under the Live-stock Slaughter Levy Collection Act 1964, detail the administrative procedures and requirements for levy collection related to livestock slaughter. Regulation 4 mandates that the payment of the levy and any other amounts payable to the Commonwealth must be made to the Collector of Public Moneys, Department of Primary Industry at specific locations corresponding to the states or territories where the slaughter occurs (Reg. 4). Regulation 5 requires the proprietor of an abattoir to submit a return and declaration regarding livestock slaughtered each month by the 28th day of the following month. This return must be made in accordance with Form 1 and can be lodged with the Collector of Public Moneys (Reg. 5). Regulation 6 allows the proprietor of an abattoir to appoint an authorized agent to execute the declaration on their behalf, and such appointments must be documented using Form 2 and submitted to the Collector of Public Moneys (Reg. 6). The Regulations impose several obligations on the parties they govern. The proprietor of an abattoir must ensure that proper records are kept for each month, detailing the number of livestock carcases slaughtered, including those that exceed specified weight limits and those that are unfit for human consumption (Reg. 7). Additionally, if livestock is slaughtered at an abattoir owned by someone else, the person causing the slaughter must provide a statement to the proprietor with the required information when requested (Reg. 8). The Regulations also outline potential consequences for non-compliance. Regulation 7 includes a penalty of one hundred pounds for failure to keep proper records as required. While the Regulations do not explicitly mention criminal or civil penalties for other forms of non-compliance, the failure to meet the obligations set out in the Regulations could potentially lead to legal action under the Live-stock Slaughter Levy Collection Act 1964 or other relevant legislation.
