Agricultural and Veterinary Chemicals Code Act 1994

 

Listed Chemical Product (Home Swimming Pool and Spa Products) Standard 2007

 

 

The Agricultural and Veterinary Chemicals Code Act 1994 (the Act) provides, within a Code set out in the Schedule to the Act, a low-regulatory scheme for agricultural and veterinary chemicals.  These provisions, contained in Part 2A, were introduced in 2003 so that industry would benefit from a decreased regulatory burden in following the registration process for low-risk agricultural and veterinary chemical products.

 

The provisions in Part 2A of the Code allow for the Agricultural and Veterinary Chemicals Code Regulations 1995 (the Regulations) to contain a schedule listing chemical products or classes of chemical products that can be granted listed registration and for which there is an established standard approved by the Minister.

 

An amendment to the Regulations, Agricultural and Veterinary Chemicals Code Amendment Regulations 2007 (No.1) made on 26 September 2007, allows that, among a number of other products, home swimming pool and spa products that contain only one of the following as an active constituent, can be granted listed registration under Part 2A of the Agvet Code:

  • calcium hypochlorite;
  • lithium hypochlorite;
  • sodium dichloroisocyanurate;
  • sodium hypochlorite;
  • trichloroisocyanuric acid.

 

This standard, the Listable Chemical Product (Home Swimming Pool and Spa Products) Standard 2007 (the Standard) is established in accordance with section 56Dof the Code and specifies the following requirements in relation to the listable chemical products:

  • formulation requirements;
  • package limits;
  • labels and formats.

 

The Standard is a legislative instrument for the purposes of the Legislative Instruments Act 2003.

 

The Standard commences immediately after the commencement of the Agricultural and Veterinary Chemicals Code Amendment Regulations 2007 (no.1).
