Environment Protection and Biodiversity Conservation Act 1999\

List of Threatened Species Amendment (363) Instrument 2023

Background

The Environment Protection and Biodiversity Conservation Act 1999 (Act) provides for the protection of the environment and conservation of biodiversity, including the protection and conservation of threatened species.

Subsection 178(1) of the Act provides that the Minister must, by legislative instrument, establish a list of threatened species (List) separated into the following categories: Extinct, Extinct in the wild, Critically Endangered, Endangered, Vulnerable and Conservation Dependent.

Paragraph 184(a) of the Act relevantly provides that the Minister may, by legislative instrument, amend the List referred to in section 178 by including items within the List in accordance with Subdivision AA.

Paragraph 184(c) of the Act relevantly provides that the Minister may, by legislative instrument, amend the List referred to in section 178 by transferring items from one category in the list to another category in the list in accordance with Subdivision AA.

The species being included in the List met the criteria for listing in the Endangered category under the Environment Protection and Biodiversity Conservation Regulations 2000 (Regulations).

The species being transferred from one category in the List to another category in the List met the criteria for listing in the Endangered category under the Regulations.

Purpose of Instrument

The purpose of this Instrument is to amend the List by:

  • Including the following species in the List:
    • Myuchelys purvisi in the Endangered category.

  • Transferring the following species by deleting the species from the Vulnerable category in the List and including it in the Endangered category in the List:
    • Myuchelys belli

Myuchelys belli is threatened by invasive species, disease, climate change, fire regimes that cause declines in biodiversity, habitat degradation and modification, human activities and translocation of other freshwater turtle species.

Myuchelys purvisi is threatened by disease, invasive species, climate change, habitat modification and translocation of other freshwater turtle species.

Subsection 186(1) of the Act provides that the Minister must not include (whether as a result of a transfer or otherwise) a native species on the List in a particular category unless satisfied that the native species is eligible to be included in that category.

Subsection 186(2B) of the Act provides that in deciding whether to delete a native species from a particular category (whether as a result of a transfer or otherwise), the only matters the Minister may consider are matters relating to whether the native species is eligible to be included in that category or the effect that the inclusion of the native species in that category is having, or could have, on the survival of the species.

Subsection 179(4) of the Act provides that a native species is eligible to be included in the Endangered category at a particular time if, at that time, it is not critically endangered and it is facing a very high risk of extinction in the wild in the near future, as determined in accordance with the prescribed criteria.

Regulation 7.01 of the Regulations provides that for section 179 of the Act, a native species is in the critically endangered, endangered or vulnerable category if it meets any of the five criteria for the category mentioned in the table to that provision.

The Minister was satisfied that the requisite criteria was met for including Myuchelys purvisi in the Endangered category in the List. The Minister was satisfied that the requisite criteria was met for transferring Myuchelys belli by deleting it from the Vulnerable category and including it in the Endangered category in the List.

Consultation

The process for making amendments to the List to include or transfer an item is set out in Part 13, Division 1, Subdivision AA of the Act. Consultation was undertaken before the Instrument was made, in accordance with the processes outlined in Part 13, Division 1, Subdivision AA of the Act.

Notice of the proposed amendment and a consultation document was made available for public comment for a minimum of 30 business days as required by subsection 194M(3). Any public comments received that were relevant to the survival of the species were considered by the Threatened Species Scientific Committee (Committee) as part of the assessment process.

The Committee prepared a written assessment of whether the nominated species was eligible for inclusion in the List. The Committee assessed Myuchelys purvisi as eligible for inclusion in the Endangered category in the List, and Myuchelys belli as eligible for transferring from the Vulnerable category and including it in the Endangered category in the List.

In making this Instrument, the Minister considered the Committee’s written assessment and any comments received during the consultation period in accordance with Part 13, Division 1, Subdivision AA of the Act.

As extensive consultation was undertaken on the proposed listing contained in the legislative instrument, it was not necessary to consult on the text of the instrument itself.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (Act) was enacted to provide for the protection of the environment and conservation of biodiversity, including the protection and conservation of threatened species. The Environment Protection and Biodiversity Conservation Act 1999 List of Threatened Species Amendment (363) Instrument 2023, issued under the authority of the Minister for the Environment and Water, aims to amend the list of threatened species by including Myuchelys purvisi in the Endangered category and transferring Myuchelys belli from the Vulnerable category to the Endangered category, in accordance with the criteria specified in the Environment Protection and Biodiversity Conservation Regulations 2000. The policy objective of this amendment is to ensure that appropriate conservation measures are implemented for species facing significant threats to their survival. This legislative instrument was made by the Minister, following consultation with relevant stakeholders and consideration of expert advice from the Threatened Species Scientific Committee, in line with the processes outlined in the Act. The Minister was satisfied that the requisite criteria were met for the inclusion and transfer of the specified species.

Scope and Application

The List of Threatened Species Amendment (363) Instrument 2023 amends the Environment Protection and Biodiversity Conservation Act 1999 by modifying the list of threatened species. This legislative instrument applies to the Minister for the Environment and Water and affects the inclusion and transfer of specific species within the list of threatened species, specifically Myuchelys belli and Myuchelys purvisi. The amendment involves moving Myuchelys belli from the Vulnerable category to the Endangered category and adding Myuchelys purvisi to the Endangered category based on assessments that these species meet the criteria under the Environment Protection and Biodiversity Conservation Regulations 2000. The changes are applicable nationally across Australia, impacting conservation and protection efforts for these species within the scope of the Act. The Minister was required to be satisfied that the criteria for inclusion in the Endangered category were met, and this was confirmed following assessments by the Threatened Species Scientific Committee and public consultation. There are no stated exclusions or thresholds in this specific instrument, but the overall application of the Act and Regulations will dictate any further limitations or exemptions.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (the Act) includes provisions for the protection and conservation of threatened species. Section 178(1) mandates that the Minister must establish a list of threatened species, categorising them into Extinct, Extinct in the wild, Critically Endangered, Endangered, Vulnerable, and Conservation Dependent. Pursuant to section 184(a) and (c), the Minister can amend this list by including new species or transferring species between categories, provided they meet specific criteria. The List of Threatened Species Amendment (363) Instrument 2023 (the Instrument) includes Myuchelys purvisi in the Endangered category and transfers Myuchelys belli from the Vulnerable to the Endangered category. The Minister must be satisfied that these species meet the eligibility criteria set out in the Environment Protection and Biodiversity Conservation Regulations 2000. The Act imposes several obligations on the Minister when amending the list of threatened species. Subsection 186(1) requires the Minister to ensure that any native species included in a particular category meets the eligibility criteria. Subsection 186(2B) further stipulates that in deciding to delete a species from a category, the Minister may only consider whether the species meets the eligibility criteria or the impact of its inclusion on its survival. Subsection 179(4) specifies the criteria for a species to be considered Endangered, focusing on the risk of extinction in the wild. Regulation 7.01 of the Regulations outlines the criteria for critically endangered, endangered, and vulnerable species, which must be met for inclusion in the list. Breaching the requirements set out in the Act can lead to various civil and criminal consequences. While the Act itself does not specify maximum penalties for breaches, the general legal framework provides for potential penalties. For example, contravening the Act's provisions could result in fines or imprisonment, depending on the severity and nature of the breach. Additionally, entities involved in activities that harm listed species may face penalties under other related environmental protection legislation, which could include significant fines and imprisonment terms. Ensuring compliance with the Act and its associated regulations is crucial to avoid these consequences.
