EXPLANATORY STATEMENT

(Issued under the Authority of the Minister for the Environment and Water)

Environment Protection and Biodiversity Conservation Act 1999

List of Threatened Species Amendment (358) Instrument 2023

Background

The Environment Protection and Biodiversity Conservation Act 1999 (Act) provides for the protection of the environment and conservation of biodiversity, including the protection and conservation of threatened species.

Subsection 178(1) of the Act provides that the Minister must, by legislative instrument, establish a list of threatened species (List) separated into the following categories: Extinct, Extinct in the wild, Critically Endangered, Endangered, Vulnerable and Conservation Dependent.

Paragraph 184(a) of the Act relevantly provides that the Minister may, by legislative instrument, amend the List referred to in section 178 by including items within the List in accordance with Subdivision AA.

The species being included in the List met the criteria for listing in the Vulnerable category under the Environment Protection and Biodiversity Conservation Regulations 2000 (Regulations).

Purpose of Instrument

The purpose of this Instrument is to amend the List by:

  • Including the following species in the List:

  • Litoria daviesae in the Vulnerable category.
  • Philoria sphagnicola in the Vulnerable category.

Litoria daviesae and Philoria sphagnicola are threatened by habitat loss, degradation and fragmentation, changes in fire regimes, climate change, disease, invasive fauna, predation and weeds.

Subsection 186(1) of the Act provides that the Minister must not include (whether as a result of a transfer or otherwise) a native species on the List in a particular category unless satisfied that the native species is eligible to be included in that category.

Subsection 179(5) of the Act provides that a native species is eligible to be included in the Vulnerable category at a particular time if, at that time, it is not critically endangered and it is facing a very high risk of extinction in the wild in the near future, as determined in accordance with the prescribed criteria.

Regulation 7.01 of the Regulations provides that for section 179 of the Act, a native species is in the critically endangered, endangered or vulnerable category if it meets any of the five criteria for the category mentioned in the table to that provision.

The Minister was satisfied that the requisite criteria was met for including Litoria daviease and Philoria sphagnicola in the Vulnerable category in the List.

Consultation

The process for making amendments to the List to include or transfer an item is set out in Part 13, Division 1, Subdivision AA of the Act. Consultation was undertaken before the Instrument was made, in accordance with the processes outlined in Part 13, Division 1, Subdivision AA of the Act.

Notice of the proposed amendment and a consultation document was made available for public comment for a minimum of 30 business days as required by subsection 194M(3). Any public comments received that were relevant to the survival of the species were considered by the Threatened Species Scientific Committee (Committee) as part of the assessment process.

The Committee prepared a written assessment of whether the nominated species was eligible for inclusion in the List. The Committee assessed Litoria daviease and Philoria sphagnicola as eligible for inclusion in the Vulnerable category in the List.

In making this Instrument, the Minister considered the Committee’s written assessment and any comments received during the consultation period in accordance with Part 13, Division 1, Subdivision AA of the Act.

As extensive consultation was undertaken on the proposed listing contained in the legislative instrument, it was not necessary to consult on the text of the instrument itself.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment and the conservation of biodiversity, including the protection and conservation of threatened species. Under the EPBC Act, the Minister for the Environment and Water is responsible for establishing and maintaining a list of threatened species, which is categorised into various levels of threat such as Extinct, Extinct in the wild, Critically Endangered, Endangered, Vulnerable, and Conservation Dependent. The List of Threatened Species Amendment (358) Instrument 2023 was introduced to address the need to include two additional species, Litoria daviesae and Philoria sphagnicola, into the Vulnerable category of the threatened species list due to their significant risk of extinction in the wild. The amendment process involved public consultation and consideration by the Threatened Species Scientific Committee, ensuring that the listing decision was made based on thorough assessment and community input. This legislative instrument aims to safeguard these species by providing them with legal protection and enabling the implementation of conservation measures.

Scope and Application

The List of Threatened Species Amendment (358) Instrument 2023 amends the Environment Protection and Biodiversity Conservation Act 1999 by adding the species Litoria daviesae and Philoria sphagnicola to the list of threatened species in the Vulnerable category. This Instrument applies to the Minister for the Environment and Water, who is responsible for maintaining the list of threatened species under the Act, and it pertains to native species in Australia facing a high risk of extinction in the wild. The Instrument operates across the Commonwealth, thereby extending its reach nationally. It does not specify exclusions, but the inclusion of species in the List is contingent upon meeting certain criteria, including eligibility based on the risk of extinction. The Minister's decision to include these species was informed by the Threatened Species Scientific Committee’s assessment and public consultation. The Instrument, as a legislative instrument under the Legislation Act 2003, comes into effect the day after its registration. The compatibility of this Instrument with human rights has been affirmed in a statement prepared under the Human Rights (Parliamentary Scrutiny) Act 2011, indicating that it does not engage any of the applicable rights or freedoms.

Key Provisions

The main operative sections of the List of Threatened Species Amendment (358) Instrument 2023 (hereinafter referred to as the "Instrument") pertain to the amendment of the Environment Protection and Biodiversity Conservation Act 1999 (the "Act"). Specifically, this Instrument amends the list of threatened species by adding two species, Litoria daviesae and Philoria sphagnicola, to the Vulnerable category (section 3). This addition is made in accordance with the criteria outlined in the Environment Protection and Biodiversity Conservation Regulations 2000 (the "Regulations") (section 4). The Instrument is structured to ensure that these species, which face significant threats such as habitat loss, climate change, and invasive species, receive the protection they need under the Act. The Act imposes specific obligations on the parties and entities it governs. Under section 178(1), the Minister for the Environment and Water is required to establish and maintain a list of threatened species, categorising them according to their risk of extinction. Section 186(1) mandates that the Minister must not include a native species in a particular category unless satisfied that the species is eligible to be included in that category. This eligibility is determined based on the criteria specified in Regulation 7.01 of the Regulations. Additionally, the Minister must ensure that any amendment to the list is preceded by a consultation process as outlined in Part 13, Division 1, Subdivision AA of the Act, including providing a minimum of 30 business days for public comment (subsection 194M(3)). In terms of consequences for breach, the Act does not explicitly outline specific offences, penalties, or civil/criminal consequences for non-compliance with the listing provisions. However, the general enforcement mechanisms under the Act, including potential administrative penalties and legal actions for non-compliance with environmental protection laws, could be applicable. The Act also empowers authorised officers to take enforcement actions, issue infringement notices, and seek court orders to ensure compliance with the Act’s provisions. This Instrument ensures that the listed species, Litoria daviesae and Philoria sphagnicola, are recognised as vulnerable and thus protected under the legislative framework designed to conserve biodiversity and manage environmental risks. By amending the list, the Instrument aims to provide a legal basis for conservation efforts and actions targeted at mitigating the threats these species face.
