Environment Protection and Biodiversity Conservation Act 1999

List of Threatened Species Amendment (344) Instrument 2022

Background

The Environment Protection and Biodiversity Conservation Act 1999 (Act) provides for the protection of the environment and conservation of biodiversity, including the protection and conservation of threatened species.

Subsection 178(1) of the Act provides that the Minister must, by legislative instrument, establish a list of threatened species (List) separated into the following categories: Extinct, Extinct in the Wild, Critically Endangered, Endangered, Vulnerable, and Conservation Dependent. This list referred to in subsection 178(1) of the Act is contained in the Declaration under s178, s181, and s183 of the Environment Protection and Biodiversity Conservation Act 1999 (List).

Paragraph 184(a) of the Act relevantly provides that the Minister may, by legislative instrument, amend the List referred to in section 178 by including items within the List in accordance with Subdivision AA.

Paragraph 184(c) of the Act relevantly provides that the Minister may, by legislative instrument, amend the List referred to in section 178 by transferring items from one category in the list to another category in the list in accordance with Subdivision AA.

The species being transferred from one category in the List to another category in the List met the criteria for listing in the Endangered and Critically Endangered categories under the Regulations. Environment Protection and Biodiversity Conservation Regulations 2000 (Regulations) (see below).

Purpose of Instrument

The purpose of this Instrument is to amend the List by:

  • Transferring the following species by deleting the species from the Endangered category in the List and including it in the Critically Endangered category in the List:
    • Banksia montana
    • Darwinia collina
  • Transferring the following species by deleting the species from the Vulnerable category in the List and including it in the Endangered category in the List:
    • Corokia whiteana

Banksia montana is considered threatened due to habitat disturbance and modification, disease, invasive and native species and climate change.

Darwinia collina is considered threatened due to habitat loss, disturbance and modification impacts, disease, climate change, interactions with native species and invasive species.

Corokia whiteana is considered threatened due to climate change, inappropriate fire regimes, invasive species and habitat loss, degradation, or fragmentation.

Subsection 186(1) of the Act provides that the Minister must not include (whether as a result of a transfer or otherwise) a native species on the List in a particular category unless satisfied that the native species is eligible to be included in that category.

Subsection 179(3) of the Act provides that a native species is eligible to be included in the Critically Endangered category at a particular time if, at that time, it is facing an extremely high risk of extinction in the wild in the immediate future, as determined in accordance with the prescribed criteria.

Subsection 179(4) of the Act provides that a native species is eligible to be included in the Endangered category at a particular time if, at that time, it is not critically endangered and it is facing a very high risk of extinction in the wild in the near future, as determined in accordance with the prescribed criteria.

Regulation 7.01 of the Regulations provides that for section 179 of the Act, a native species is in the critically endangered, endangered, or vulnerable category if it meets any of the five criteria for the category mentioned in the table to that provision.

The Minister was satisfied that the requisite criteria was met for transferring Banksia montana by deleting it from the Endangered category and including it in the Critically Endangered category in the List, transferring Corokia whiteana by deleting it from the Vulnerable category and including it in the Endangered category in the List, transferring Darwinia collina by deleting from the Endangered category and including it in the Critically Endangered category in the List.

Consultation

The process for making amendments to the List to include or transfer an item is set out in Part 13, Division 1, Subdivision AA of the Act. Consultation was undertaken before the Instrument was made, in accordance with the processes outlined in Part 13, Division 1, Subdivision AA of the Act.

Notice of the proposed amendment and a consultation document for both species were made available for public comment for a minimum of 30 business days as required by subsection 194M(3) of the Act. Any public comments received that were relevant to the survival of the species were considered by the Threatened Species Scientific Committee (Committee) as part of the assessment process. Due to the nature of this consultation process, it was considered unnecessary to undertake additional consultation following the drafting of this specific instrument.

The Committee prepared a written assessment of whether the nominated species were eligible for inclusion in the List. The Committee assessed: Banksia montana as eligible for transferring from the Endangered category and including it in the Critically Endangered category in the List; Corokia whiteana as eligible for transferring from the Vulnerable category and including it in the Endangered category in the List; Darwinia collina as eligible for transferring from the Endangered category and including it in the Critically Endangered category in the List.

In making this Instrument, the Minister considered the Committee’s written assessment and any comments received during the consultation period in accordance with Part 13, Division 1, Subdivision AA of the Act.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) provides for the protection of the environment and the conservation of biodiversity, including the protection and conservation of threatened species. Under this Act, the Minister for the Environment and Water is tasked with establishing and amending the list of threatened species, which is categorised into Extinct, Extinct in the Wild, Critically Endangered, Endangered, Vulnerable, and Conservation Dependent. The List of Threatened Species Amendment (344) Instrument 2022 was enacted to address the need to update the classifications of certain species based on their current conservation status. This legislative instrument was made under the authority of the Minister for the Environment and Water, with the primary policy objective of ensuring that species are accurately categorised to reflect their actual risk of extinction. The instrument aims to transfer certain species from one category to another based on assessments by the Threatened Species Scientific Committee, thereby facilitating more targeted and effective conservation efforts. The changes in category were made following consultation with relevant stakeholders and public comments, ensuring a balanced approach to the protection of these species.

Scope and Application

The List of Threatened Species Amendment (344) Instrument 2022 amends the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) by modifying the list of threatened species, specifically transferring certain species to different categories based on their conservation status. This legislative instrument applies to all entities and individuals within Australia, as the EPBC Act operates at the Commonwealth level and has a national reach. It pertains to native species listed under the Act, which includes plants and animals that are identified as threatened and thus subject to protection and conservation measures. The Instrument specifically addresses the transfer of Banksia montana and Darwinia collina from the Endangered category to the Critically Endangered category, and Corokia whiteana from the Vulnerable category to the Endangered category, based on assessments of their risk of extinction. The changes are made pursuant to the authority granted under sections 178, 184(a), and 184(c) of the EPBC Act, and the amendments are operational from the day after the instrument is registered. The Minister for the Environment and Water ensures the compatibility of this Instrument with human rights as declared under the Human Rights (Parliamentary Scrutiny) Act 2011, with no adverse implications on any rights or freedoms.

Key Provisions

This Legislation Instrument amends the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) list of threatened species by transferring three species between different categories based on their conservation status. The main operative sections involved in this amendment are sections 178, 184(a), and 184(c) of the EPBC Act. Section 178 requires the Minister to establish a list of threatened species, which is currently maintained under sections 178, 181, and 183 of the Act. Sections 184(a) and 184(c) provide the Minister with the authority to amend the list by including new items or transferring existing items between categories, respectively. This particular Instrument transfers Banksia montana and Darwinia collina from the Endangered category to the Critically Endangered category and transfers Corokia whiteana from the Vulnerable category to the Endangered category. The Act imposes specific obligations and requirements on the Minister when amending the list of threatened species. According to subsection 186(1) of the Act, the Minister must not include a native species in a particular category unless satisfied that the species is eligible to be included in that category. Eligibility criteria are set out in subsections 179(3) and 179(4) for the Critically Endangered and Endangered categories, respectively, and are further detailed in Regulation 7.01 of the Environment Protection and Biodiversity Conservation Regulations 2000. The Minister was satisfied that the requisite criteria were met for the transfers specified in this Instrument, based on the assessment of the Threatened Species Scientific Committee and public consultation. The Act and the Regulations do not explicitly outline offences, penalties, or consequences for breaches related to the listing of threatened species. However, breaches of the Act and Regulations can lead to legal consequences under other provisions, such as prohibitions on actions that harm listed species or their habitats. The maximum penalties for offences under the EPBC Act can include substantial fines for individuals (up to $333,000) and corporations (up to $1.65 million), as well as imprisonment terms that vary depending on the severity of the offence. Additionally, civil and criminal penalties can be imposed for non-compliance with conditions attached to approval or authorisation under the Act.
