Overview

The Australian National University Liquor Statute 2006 was enacted to address the need for specific regulation of the sale, supply, purchase, and consumption of liquor within the premises of the Australian National University. This statute was introduced under the authority of the Australian National University Act 1991, specifically section 50, which empowers the University to create such regulations. The purpose of this statute is to establish a comprehensive framework for managing liquor-related activities on campus, ensuring safety, order, and compliance with the University's policies. The development of this statute involved extensive consultation with various stakeholders, including staff, students, trading organisations on campus, and colleges and halls of residence, to ensure that the regulations are balanced and considerate of all interests. The Council of the University reviewed and approved the statute, reflecting its commitment to maintaining a safe and orderly environment conducive to education and research.

Scope and Application

The Australian National University Liquor Statute 2006 applies to all individuals and entities operating within the physical confines of the Australian National University's buildings and grounds, governing the sale, supply, purchase, and consumption of liquor. This includes staff, students, trading organisations on campus, and the colleges and halls of residence, ensuring that liquor-related activities are regulated uniformly across the institution. The statute is a jurisdictional instrument under the Australian National University Act 1991, with its geographic reach limited to the premises of the university, thereby not extending beyond these confines. The statute does not specify any exclusions, exemptions, or thresholds but leaves room for the creation of Orders to further specify its application and enforce its provisions. Subordinate instruments, such as the Orders mentioned, may be used to extend or restrict the application of the statute, thereby providing flexibility in managing liquor-related activities on campus.

Key Provisions

The Australian National University Liquor Statute 2006 outlines the rules and regulations concerning the sale, supply, purchase, and consumption of liquor on university premises. Section 5(1) sets forth the primary objective of the Statute, which is to provide a framework for the management and control of liquor on campus. Under Section 6(1), it is stated that liquor can only be sold, supplied, or purchased within specified areas and under certain conditions. These areas are defined in Section 7(1), which lists the specific buildings and grounds where the sale and supply of liquor are permitted. The consumption of liquor is regulated by Section 8(1), which prohibits drinking in certain areas such as classrooms, libraries, and administrative buildings. The Statute imposes several obligations on the parties involved. Section 10(1) requires the University to display notices detailing the rules and regulations regarding the sale, supply, and consumption of liquor. Section 11(1) mandates that vendors must obtain a licence from the University to sell or supply liquor on campus. Additionally, Section 12(1) states that individuals must be of legal drinking age to purchase or consume liquor, and vendors must verify the age of purchasers. Section 13(1) also requires that all liquor sold on campus must be purchased from approved suppliers. Failure to comply with the provisions of the Statute can result in various consequences. Section 17(1) outlines that any person found violating the rules regarding the sale or supply of liquor can be subject to a penalty, including fines up to $5,000 for individuals and $25,000 for bodies corporate, as stated in Section 18(1). Section 19(1) specifies that the University has the authority to suspend or cancel liquor licences for repeated or serious breaches. Furthermore, Section 20(1) indicates that repeated violations by individuals can lead to further sanctions, including suspension or expulsion from the University, as outlined in Section 21(1). These provisions ensure that the Statute is enforced effectively to maintain a safe and orderly environment on campus.
