Overview
The Statutory Rules 1969 No. 108, made under the Lighthouses Act 1911-1966, were enacted to amend the existing Lighthouses and Light Dues Regulations. These regulations were introduced to address the need for updates to the fee structure and allowances for lighthouse operations, including adjustments to allowances for meals and travel. The enacting body was the Governor-General in Council, reflecting the legislative authority vested in the Commonwealth of Australia to manage maritime aids to navigation. The policy objective was to ensure that the regulations remain current and adequately support the operations and maintenance of lighthouses across Australia, including in external territories, by adjusting fees and allowances to reflect contemporary economic conditions.
Scope and Application
The Lighthouses and Light Dues Regulations 1969, made under the Lighthouses Act 1911-1966, apply to all persons and entities involved in the maritime industry, including ship operators, maritime pilots, and lighthouse authorities, across the Commonwealth of Australia and its external territories. The regulations primarily address the fees for lighthouses and light dues, providing a structured framework for the financial transactions associated with maritime navigation aids. This includes the fees for meals and travel allowances for members of the Lighthouse Advisory Committee. The amendments to the regulations, such as the introduction of the term "External Territories" and the revision of meal allowances, extend the application of the Act to encompass maritime activities in Australia's external territories and update the financial provisions to reflect current costs. Any further extensions or restrictions of application are managed through subordinate instruments as specified within the regulations themselves.
Key Provisions
The main operative sections of these regulations primarily concern the amendment of existing regulations under the Lighthouses Act 1911-1966. Regulation 5, which establishes the Lighthouse Advisory Committee, is amended to include "External" territories within its purview (Regulation 1). This signifies an expansion of the committee's geographical oversight to include territories outside the traditional scope. Regulation 11, pertaining to fees, travelling allowances, and tare weights, is also amended (Regulation 2). The table detailing meal allowances is replaced with new rates for breakfast, midday meal, and evening meal. The new rates are set at one dollar for breakfast, one dollar and ten cents for midday meal, and one dollar and ninety-five cents for evening meal. These amendments reflect updated provisions for administrative and operational aspects of the Lighthouses Act.
The obligations imposed by these regulations primarily involve the Lighthouse Advisory Committee and any personnel involved in the administration and oversight of lighthouses. The inclusion of "External" territories in Regulation 5 means that the committee must now extend its advisory role to these areas, ensuring that lighthouse regulations and operations are consistent and compliant across all specified territories. Additionally, those responsible for the logistical and financial aspects of lighthouse operations must adhere to the new meal allowance rates outlined in Regulation 11. This includes ensuring that appropriate allowances are provided to staff based on the updated rates.
For breaches of these regulations, the Lighthouses Act 1911-1966 provides for various offences and penalties. While the specific offences and penalties are not detailed in these regulations, the overarching act likely includes provisions for non-compliance with advisory roles, operational standards, and financial regulations. Penalties could range from fines to more severe administrative or legal actions, depending on the nature and severity of the breach. The exact penalties would be determined in accordance with the relevant sections of the Lighthouses Act.
