Licence Area Plan – Port Hedland Radio


DETERMINATION

(1) This plan for broadcasting services in the Port Hedland area of Western Australia is made under subsection 26(1) of the Broadcasting Services Act 1992.

(2) Six national radio broadcasting services, two commercial radio broadcasting services and two open narrowcasting radio services are to be available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 – 1.14 to this plan.

(3) One community radio broadcasting service is to be made available in the area described at Attachment 2.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachment 2.2.

(4) In this plan, unless the contrary intention appears:

(a) a reference to a schedule or an attachment includes a reference to that schedule or attachment as amended from time to time;

(b) a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and

(c) a reference to any other kind of instrument or writing is a reference to that other instrument or writing as in force or in existence at the time the reference was included in this plan.

Overview

The Broadcasting Services Act 1992 was enacted by the Australian Parliament to establish a regulatory framework for broadcasting services in Australia. The Act aimed to address the need for a cohesive and effective regulatory system that would facilitate the operation of commercial and community radio services, as well as television services, while ensuring that the broadcasting spectrum is used efficiently and for the benefit of the public. The Licence Area Plan – Port Hedland Radio is a legislative instrument made under the Broadcasting Services Act 1992, which specifies the availability of various radio broadcasting services in the Port Hedland area of Western Australia. This plan, determined by the Australian Broadcasting Authority on 21 June 1996 and subsequently amended, details the technical specifications and areas served by six national, two commercial, and two open narrowcasting radio services, as well as one community radio service.
